Spouse Visa with A new Job

Thank you for your help.
I need help with my application for spouse Entry visa from Nairobi. I am British Citizen living and working in the UK and recently got married in Nairobi.
I meet all the requirements for the spouse visa and was preparing to apply for spouse visa for my wife after receiving this months pay slip and bank statement to submit 6 months pay slips and corresponding bank statements. I was employed by the same company for few years now.
I have now received an offer from another company with a better job and a much better salary. I have to accept the offer or miss the chance so I want to take that offer and resign from my current job.

At the same time I want to apply for my wife's visa as planned in the next week or so (before the lapse of 28 days from this month's payslip and bank statement).

I will have the following documents to satisfy the financial requirement:
1) 12 months payslips and corresponding bank statements (All from my current company that I intend to resign from).
2) Employment letter from my current company detailing my employment with them under my current contract conditions (start date, the payment, type of job, job title and the number of years employed with them.
3) My p60 for 2017/18 and my p45
4) I will also have my new contract from my new employer and an employment letter from them confirming my contract conditions but will not have yet received payslip as I have not completed with them one month and will not have a bank statement showing their salary yet.

My question is can I apply for the spouse visa in the above conditions under Category A or B or do I need to wait for at least one month to receive a salary from the new employer.
Is it a condition to have received a salary from the job you have just started if you can show that you satisfy the required amount from your 12 months salary of the previous job.

Preferably wait until you get your 1st month payslip from new employer then apply under category B where you have to supply 12 months payslips and bank statements.

If I take your advice and wait for 1 months salary from new job I will face the problem of having the employment letter from my previous employer dating more than 28 days. Wouldn't that be a problem?
It is my understanding that to apply under category B and 12 months combined payslips from both employment I will need to provide employment letters from both companies and my current employer would provide me one now but not after I leave them. The one that they provide me now will be outdated in 28 days.

Is my understanding wrong and I would only need the payslips from the previous employer and an employment letter only from the current employer and of course the 12 months corresponding bank statements?

If that scenario poses a problem can I apply for the spouse visa now under category A with 6 months payslips from my current employment before I leave the company as I am under the rules still on employment on the date of application and earning more than the required 18600 but I am working for them under the 30 days notice period as per my contract and they may mention in their employment letter that I am in the notice period before I leave them.

Hello board members.
My wife just submitted her spouse visa application in nairobi today and used the priority visa service. As I mentioned in my original post above I have resigned from my current job and was working under the notice period. Tomorrow of July is the last day for my employment on this job. I am starting the new job in the next week. Tecnically as I am employed on the application date and have been in that employment for more than 6 months and being paid an amount meeting the required financial threshold, she has applied under category A (6 months payslip and bank statement)

I hope they dont have any objections regarding the employmnt. I will let the board know the outcome for your reference.

They have today updated the status of my wife's application in the Tlscontact Visa Centre website as "Decision Made".

I hope it is good news. It was relatively fast compared to the timelines mentioned by the other users.

My question is how long does it take when they say "decision made" and when they actually contact the applicant to collect his/her passport? My wife did not get any email except the first email on the day they submitted the application to UKVI in which they informed her they have submitted her application to the UKVI and that she can track the status of her application from the Tlscontact website.

I think you had applied under category A. Were your previous and new employer was contacted?

You are right I have applied under Category A and supplied six months payslip and bank statements. I did not mention that I would be leaving my job soon as I didnt see any question to that effect. All they asked was whether I was employed and when I started it. So they have no idea about my current job now and therefore did not definately contact them.

I can not be certain, though, if they contacted my former employer or not as I dont work there any more and they did not inform me that somebody contacted them.
We will have to wait and see the outcome I guess

Here is the time line
Application Submitted online 7 July 18
Biometrics and Documents submission at Visa Centre : 12 July 18
Service bought : Priority
Decision taken notification: 02 August 18
Passport returned with the visa: 3 August 18
Total days from biometrics: 22 days

Sorry Seagull, Somehow, I didn't not see your question about the documents we used!!

From the Applicant's Side:
1) Print out of the online application VAF4A (signed)
2) VAF4A-Appendix2 (Category A)
3) IELTS LIFE SKILLS A1 (Taken at the British Council in Nairobi)
4) TB Test Certificate from an approved Centre in Nairobi
5) Original Current and Old passport of the applicant

Financial Proof:
1) Letter From the Employer confirming my employment contract and detailing the start date, current salary, and current job title ( They stated my first position and salary in the company when I first started as well as all the salary increments I got according to their HR policy till my current salary) and that the job is full time and permanent and that my salary of xxxx is paid to my bank account by BACS, thereby confirming the authenticity of the pay slips at the same time)
2) Six months original pay slips
3) Six Months corresponding bank statements printed from online and stamped by the bank on every page.

Relation ship proof:
1) Marrige Certificate in English issued in Nairobi court and authenticated by both the family court and ministry of foreign affairs.
2) Wedding Invitation Card
3) Contract for a furnished appartment in Nairobi in our names for the three weeks I stayed there for our wedding and honey moon (We had our marriage which was an arranged marriage in Nairobi)
4) Airline tickets for me when I have visited her in Nairobi for the wedding and airline tickets for us together when we went away for a holiday the second time I visited her in Nairobi
5) Photos of us together and families and guests during the wedding ceremony and other photos of us after the wedding and during our holidays. We have annotated each photo by its date and location and highlighted any family member that appears in it.
6) Gift Receipts
7) Receipts for monthly money remittance I send to my wife monthly for her personal use as a support.
8) Sample screen shots of our whatsapp chat communications with each other when we are not together to proof genuinity and subsistance of our relationship

Proof of accommodation and intention to live together:
1) Contract agreement for a newly rented Two bedroom apartment with my wife's name added to the contract in anticipation of her arrival to the UK.(Just rented the house a week before the application date and hence did not have any utility bill for that address. I have therefore only submitted the rent contract.)

Cover Letters:
1) Cover letter written by me stating my support for the application and detailing how were introduced to each other by our parents in an arranged marriage and that we are both well over the legal age of marriage and that we agreed to that arrangement, how our relationship developed from there both before the marriage and after it. I have emphasized how we met each requirement of spouse visa rules.
2) Photo copy of Every page of my passport to show the travel history ( I have highlighted and annotated the entry and exit stamps that matched my tickets)


To make life easy for the visa officer we have arranged the documents in a neat order according to the spouse visa requirements and annotated each section accordingly: The application forms, the language and TB certificates, the relationship documentations, the accommodation, the financial proof etc.

I had doubts that they may raise questions about the arranged marriage so I have fully explained it in the cover letter and my wife has done the same in the last section of the of the VAF4A-Appendix 2 ( Extra information).

That and the fact that I have left my job the day after her biometrics and documents were submitted in the visa application center.
Thankfully no body contacted me, my wife or my employer until we received her passport for with the visa stamped.
For the priority service applications in Kenya, the applications are processed and decided in the British council in Nairobi while non priority visas are sent to Pretoria, South Africa. So she has submitted everything to the center during her biometrics and I did not need to send any other documents to anywhere else.
