Help! Help!! Help!!!

I have a major issue now that is very serious. I had a son who came into the country at Age 5 and now that I got my indefinite and would like to regularise my son stay as well. He will be 18 by September 2018.

MY QUESTION IS WHAT APPLICATION CAN I MAKE ON HIS BEHALF.

Did he enter the UK legally? You'll have to give more information if you want anyone to advise you. :idea:

Thank you for your prompt reply, The whole thing is complicated as He enters into the UK legally on a different name entirely before adopting my surname. I think this is where the problem is to prove that he was here legally because he has another name from what he came here with.

Was he legally adopted through the courts or did you simply change his surname?

What visa did he enter on and how long was it valid for?

Is he your biological son or step son et? Why did you need to change his name?

I know one case where the visa was refused due to a name issue. If you have proper documentation of the name change along with the a document which states that you legally adopted this child then I believe you will have a case to present.

Let me break it down here.... I had a one of relationship with the mother which led to the birth of my boy. I refused to take responsibility at first, and when my family got involved, after a while I agreed to accept the boy.

So when the boy came to the UK with his Mum, he was answering his step Dad name on 6months visa not my surname. I decided to have him with me and change his name to my name when I registered him to school here in the UK. Throughout all his primary, secondary and high school he answered my last name.

I am the biological father and the bc was on my name from day one but the only mistakes the mother made was that when he wanted to bring him to the UK. She made passport and visa on his step Dad name which make it difficult for me to prove how he got to the UK.

Now he doesn’t have any status but I have indefinite and I was wondering what application can I make for him before he clock 18yrs.

I hope my explanation is clear and I’m sorry for any confusion.

If you have not formally changed the surname, this will be a problem.

Where is the mother??

Do you have DNA evidence to prove you are the father??

What visa did the mum enter the UK with?

Was the mum married to 'step dad' at the time of the birth??

The mother is in the UK

She also came with 6months visitors visa but expired (No status)

Yes I have DNA to show that I am the biological father.

The mother wasn’t married to his step Dad at all

How was the child able to get a passport on the other guys name, if your name is on the birth certificate.

On what Birth certificate was he able to get the passport?

As a matter of law, what matters is that the child is under 18 and has lived in the UK for 7 years or more, which seems to be the case. He will need to demonstrate by other means, that he has lived here for 7 years or more, your ILR will not make much difference, unless the mother is not in the picture.

The mother claimed that the step Dad was the Dad at the time and I’m not sure what documents she present to secure the passport.

At the moment the mother is not in the picture.
