Need help with applying British Citizenship

Hi All

My cousin (My maternal uncle's daughter) wants to apply for british citizenship. Her father had a british passport (blue one) issued in 1977. My uncle (my cousin's father) got his passport because his father was British by birth and came to Pakistan before partition of India and Pakistan.

So my cousin wanted to know what will be the way for her to apply for british citizenship/passport.

Did your cousin's father ever reside in the UK? If so, is there any documentary proof of such residence?

When was your uncle (the father of the cousin born)? When was your cousin born? If she was born before 1983, did her father register her with the British High Commission in Pakistan within one year of her birth?

It is possible that she cannot claim British citizenship directly, if her father did not register her with the British High Commission before 1983. But as she has a British born grandparent, she could apply for an Ancestry visa.

No my uncle never lived in UK and he was born in 1946. He was given his british passport in Pakistan in 1977 The blue one). My cousin was born in 1985 and her birth was never registered with the high commission. one more thing she is a christian by birth. My mother was also christian but she converted to Islam at the time of her marriage.

So is there any chance she can apply for british nationality of british passport because her father was british by birth because her grandfather was british by birth as well.

I doubt your cousin can apply directly for a British passport.

Section 12 of the British Nationality Act 1948 lists those British subjects that became CUKCs at commencement of the Act in 1949. Subsection 8 of that section listed who were CUKCs by descent only, who could not pass on their British citizenship to their children automatically. Your uncle was a CUKC and later a British citizen under Subsection 2.


He could not pass on his British citizenship to his children automatically. As your cousin was born after 1983, he could have registered her as a minor if either he had lived in the UK for three years before her birth or if he had moved to the UK and lived with her in the UK for three years before she turned 18.

As she is past 18 now anyway, there is not much she can do to acquire British citizenship based on her descent. She is of course eligible for an Ancestry visa.

Thank you for the reply. I totally undertsand what you are saying.
Just one more thing, what would happen if we can prove that our grandfather was a British Soldier at the time of my uncle's birth, would it make any difference because i was reading through the information on gov.uk site and it stated that children of British overseas soldiers (especially who are serving in aremed forces) will be British by Birth. Is that possible to claim that right now for my cousin?

Because we do have record that shows that he was in British Army till Dec 1947. So can we apply for my cousin as British Citizen under this law??
