My friends partner is pregnant, he's an overstayer.

Post by Peekay216 » Sat Jul 07, 2018 9:04 pm

Hi everyone,

To give a brief background: he initially came to the UK in September '12 on a student visa which expired in aug '16. He says that he had to redo a few modules so his course initially got extended ( it was expected to finish in 2018) however, before he got to the end, he was asked to withdraw due to unsatisfactory improvement in '15. He tried to apply to a few different unis but due to timings and something amiss in his transcripts he ddnt get accepted.

It put him in a really depressed position and he wasn't able to go home for 2 reasons. His family had relocated to a different country to where he was born and brought up & they weren't welcoming to him at the time.

He met his current partner during that time and they've been living together since. They're in a genuine relationship and are quite happy together however he's just found out that his gf's pregnant and they'll be having a baby.

He's been an overstayer since '16 but he doesn't want to keep living like this. What are his options?

He stands a better chance of a FLR(FP) Partner (10 year) route succeeding once his child is born. That's assuming he can prove at least 2 years co-habitation with his partner, in a relationship 'akin to marriage'
(Casa, not CR001)

He says that he's facing a lot of problems staying here and 10 years is a long time. It'd be better for him to go home and break the news face to face but at the same time he's worried that going back might deteriorate his chances of coming back. What are the rules on voluntarily leaving?
