Applying for ILR under 10 year rule

Post by Omi00007 » Sat Jul 07, 2018 5:48 am

Hi all,

I am asking this question on behalf of a friend. He will be applying for ILR under the 10 year rule at the end of this year and he currently has an EEA Family member card that's valid for another 4 years.

When he applies for ILR and receives it (hopefully), will he need to surrender his EEA Family member card? The reason I am asking this is because currently he can travel to EU with his wife on this card without a visa. However, Once he has ILR and if he has to surrender his EEA RC then he will need to apply for a visa everytime he wants to travel to the EU.

Any advise/guidance would be appreciated...

even he is not EU nationals, but a family member of a EU citizen, should apply through this route.

but not ILR 10 year route.

Thanks for your reply. Based on his current situation he only qualifies for pre-settled status and the details of that status are still yet to be finalised by HO/Parliament.

I am still curious to know what happens to the EU RC when someone on EU Family Member visa acquires ILR through 10 year residency rule?

Nothing as in he can continue using his EU Family member card to travel to Europe visa free with his EU Spouse after getting an ILR?
