Hello Board Members,

I am very new to this forum and any help will be much appreciated.

I have a question regarding my IRL application as when I can apply for the indefinite Leave to Remain Long Residence application. I came to the UK on the 12 September 2008 and have lived in the UK without any breaks. My current visa status is Tier 1 Entrepreneur which expires on 15th August 2018 and my qualifying period for 10 years will be 12th September 2018. However, I can apply 28 days before which will be on the last day of my current visa which is 15th August 2018.

So, my question really is if I can get one day service appointment for 15th August, am I eligible to apply for settlement via ILR long residency and will there be any questions raised by home office for applying on the last day of my current visa and not going for ILR through Tier 1 Entrepreneur?

Please can you advice me and any help will be much appreciated before I make my one day service appointment. Thank you in advance 🙏

Yes you can apply on the last day of your visa, in person or by post, if that is within 28 days before original date of entry.

Thanks for your prompt reply CR001. I am slightly confused here when you say within 28 day before original date of entry. If I count backwards from 12th Sep to 15th August that is exact 28 days before and my last day of the visa falls on 29th day does that mean I am still eligible to apply because my appointment/post will made or sent on the 29th day?

I am unable to check your dates on the time and date website as I am using my mobile on a train. When I have a moment tomorrow I will see.

Hi CR001,

Sorry to bother you again. just wondering if you manage to check the dates if I can apply on 15th August ?

Any other experts/gurus please give your opinions/suggestions that will be great.

Phew...ur in luck! 28th day falls on the last day you can legally be here. You complete 10 years on 11/09/18. Going back 28 days- 15th August 2018. Make sure you post it that day or go to the window!

Thanks for your response. I was under the impression that my 10 years will be completed on 12/09/2018 and not 11/09/2018? and if I go back 28 days before from 12/09 that will be 15/08 which is from my qualifying period?

The only thing I am not clear about is that the premium service has to be within 28 days of qualifying period, does that mean I am ok to apply on 15/08 ?

Any other experts on this board please share your thoughts it will be much appreciated and helpful?

Maintenance Funds for Tier 1 Ent Settlement

Hi Board members,

I am looking for some advice from Gurus re maintenance funds. Just want to check if I need to show maintenance funds of £985 for last 3 months when applying for ILR (0) 5 years settlement on Tier 1 Entrepreneur visa?

Not applying based on 10 years long residence anymore??

For ILR based on 5 years Tier 1 Ent, there is no maintenance fund requirement.

Thanks for your prompt reply once again. No I am going to be applying based on 10 years long residence route but I was just making sure in case there is a problem with my 10 years long residence route when I go for premium appointment I can apply based on tier 1 entrepreneur settlement route.
