Thanx macgrath looking at my refusal point do you think it’s worth applying again as they refused on silly interview based points not on documents or it’s good to just go for JR as I am pretty confident on my points

JR does not fall under the UK Immigration rules so you if you do not reapply within the 14 days of refusal, you will be an overstayer. JR does not give you Section 3C protection either (if you currently have it).

You can reapply and do JR simultaneously.

So that means I can’t apply only JR but I thought I will be overstayer anyway after AR refusal

My question is After AR refusal my 3c will end and if I decide to only apply JR and not to apply fresh application in country can I do that or I have to apply JR and fresh application together reasone I am thinking is I have confidence to win in JR we have done nothing wrong and they gave genuineness reason which they can give even I apply again. Because I don’t think any perticular document can resolve their doubts apart from cover letter which we already explained in AR

As repeatedly covered on this forum, JR and immigration rules are NOT RELATED.
JR is part of the administrative law, to challenge a public body in court for doing something UNLAWFUL.
In order to submit a new immigration application, you must apply within 14 days of becoming an overstayer. This is NOT RELATED to JR procedures

Macgrath Zumba I have applied AR on 24/5 and I finished 28 calander days yesterday and I have not heard anything from them .

Wait to hear back. You can purse JR in parallel if you want. Make sure to apply for a new application within 14 days if your AR was unsuccessful

Whats new rules of immigration HC1154? If someone got refusal on AR and submit new application within 14 days after 7 July 2018, will he be overstayer?

My Ar still not received its 31 days and my wife s employee did ecs last week and it came positive for 6 month does this mean anything

No meaning.

As long as the AR is not decided, the Section 3C protection continues

My Ar still pending first they sent email after 28 days that we will take another week which fishes today and we received another email today saying we are making some inquiries regarding your case and we are waiting for outcome of that inquiries so we will decide before 18 July can you please comment on this

There is no comment to make.

HO has a strong record of not following any timelines it sets for itself even - so really nothing to do but wait.

That is interesting.

I have not seen this before in the forum, but I expect the only two reasons for a full IHS refund is 1) A mistake 2) Visa refusal.

Since it can be 1) wait for any formal letter

Macgrath sad day for us today our AR got rejected and gave us silly reason not even replied properly now situation is my parter is going for long residency category plus JR and I am planning to apply for JR only I do not want to apply for fresh application as its refused on genuineness so can not make any difference my question is if during JR process my partner get visa what will happen to me

You are an overstayer now. JR is not a process under the immigration rules and does not give you any section 3c protection. If you lose JR, you will likely have to pay HO costs.

Useful to state the exact wording of the AR refusal.

You will be an overstayer, can't work, no free NHS, unable to rent if you do rent etc.

If you don't make a new application, which you do simultaneously as the JR, you won't get a new visa. So if your partner applies and you don't, he can potentially get a visa but you won't as you have not applied.
