Is my british child part of financial requirment for spouse visa?

Hello all

My Pakistani partner is on Tier4 Student Visa here in UK since 2011, I am British and we are living together for 18 months now [after Nikah(Muslim) no certificate]

Reading the forum I understood that
  1. I can marry him by giving notice to my local registry office
  2. He can apply for spouse visa. Also can use same day service
  3. I can sponsor him if my income is over £18600.
Please confirm or correct assumption above and the question I want to ask is I have 1 British 7 years son from previous marriage . divorced now.
  • Do I need to count my own son as part of income requirement?
    I am working for over 4 years now and earning about £20k.

Yes, you have to give 28 days notice to an HO approved Registry office and they will inform HO and this notice period might be extended to 70 days for HO to investigate/interview each of you before permission to marry will be granted. Hopefully the student visa does not expire any time soon.

No, British children are NOT included in the financial calculation.

2 years co-habitation is only relevant for an Unmarried Partner Visa.
(Casa, not CR001)
