Hi,

Some feedback on my final documentation for ILR (PEO aptt) would be appreciated.

Imigration history:

Spouse visa issued:10/03/2013
Spouse visa expiry: 12/12/2015
FLR M BRP issued: 29/12/2015
FLR M BRP expiray: 19/07/2018

ILR Appt – 16/07/2018

SET (M) Checklist:

Introduction & Identity:

Appointment booking confirmation print out
Payment confirmation print out
Application Form (SET M) (not stapled)

Proof of language:

1. LITUK Test certificate

2. B1 Certificate from Trinity college

Applicant’s Current Passport

House inspection report used in my initial spouse visa and FLR (M)
Letter from sponsors mother she was happy for us to stay during the peroid above

Current home:
Tenancy agreement
Recent rent statement

Sponsors mother is currently away and my husband has written a letter stating that and a direct contact number for her if they need her confirmation?

Financials:

Applicant 6 months bank statements
Sponsor Letter from employer confirming employment details
Sponsor Letter from employer confirming the authenticity of the printed payslips.
Sponsor Recent promotion letter
Sponsor Payslips – 6 months
Sponsor Banks Statements - Corresponding 6 months

Salary was going to into a HSBC Advance saving account from Jan 2018 to April 2018, Now into Natwest current account from May 2018 payment, We are submitting 6 months of both accounts, the payslips also show which account payment went into, hopefully this is fine, do we need a letter in the application to explain this?

We also have letters addressed to my daughter/son– GP registration, hospital apt. Do we take these?


5 years continues residency:

Applicant college letter - printed ans stamped by college (Dec 2013)

Do we need Evidence for the Sponsor as well? If so, we have letters and bills

Do we need to Evidence of the Applicants trips out of the UK as well? we have printed airline bookings just in case.

Is there a set number of days the applicant can be away during the 5 years residency?

For proof of residence??? No. You only need letters to each of you or jointly addressed proving cohabitation.

I entered the UK on 18/04/2013

OK is 1 peace a year for each of us OK, 1 for 2013, 2014, 2015, 2016, 2017 and 2018. Yes they are bills, letters from NHS and statements.

On what about accommodation?

Really!! I was told by lawyer that I should apply within the last 28 days of my BRP expiry.

"You need items for every 3 or 4 months, either in joint names or addressed individually to the same address, for the 2 years preceding your ILR application."

We have these spaced out 4 months and 6 months on other occasions as almost all of my stay in the UK was at my sponsor mothers home.

Lawyer was wrong. You can apply within 28 days before reaching 5 years residence, which starts counting from the date you entered the UK.

Then what you have prior to your own place is fine, but you don't need the property inspection report or letter.

Then what you have prior to your own place is fine, but you don't need the property inspection report or letter
18/04/2013 to 19/04/2018 almost 5 years we lived at my sponsor mother home. For my initial visa and FLR M applications we used:
property inspection report
sponsor mother tenancy agreement
letter form from sponsor mother to say she happy for us to live there.

This year on 19/04/2018 we have moved out to our own property.

My question is do I need to provide the above documents and sponsors Mother letter confirming we stayed from 18/04/2013 to 19/04/2018 to prove our 5 years continues residency? We only been in our property for 3 months and have correspondence for that period only.

Sorry another question, our bank statements are paperless and had to order last 6 months statements but they never arrived, so we printed out from online banking and got NatWest branch manager to Stamp sign and attach he's business card to every statement, I believe this is ok?

However HSBC will not stamp statements, also original have not arrived when ordered by phone, so I made angry call yesterday and they told me, they sent and email to my local branch manager to sign the statements and attached their business card with a letter of authentic, is this also OK?

Forgot to add, the letter was date on 22/06/2018 when she was here in the UK, she is currently in Kenya, does my sponsor need to add letter that she out of the country and provide her direct number, or does she need to write a new letter and scan it to us stating she is out of the country and provide her direct number.

Or will the current letter be enough and we are worrying too much?

Is there a limit my on my absesnse from the during my last 5 years, we callculated all the days and total days spent outside the UK was 228 from 18/04/2013 to today.

The longest trips were in:

2014 for 49 days where I visited my family and attended my sisters wedding.
2015 for 69 days I spent my pregnancy with my mother and family.

We have listed all trips in a spreadsheet and provided the reason of the trip.

So question: is there a limit on the number of days I can be away during the last 5 years or a limit allowed to be away in a year e.g 2015 i was away for 69 days, longest i was away?

On the SET M Version 04/2018 (this is the correct one right?) It says:
SECTION 2C: YOUR RELATIONSHIP WITH YOUR CHILD - Complete if you
are applying as a parent of a child who is present and settled in the UK

SECTION 2C: Complete this section if you are the single parent of a child or children in the UK and you
have had leave to remain as a parent for a continuous period of at least 60 months and you continue to
have sole or shared responsibility for the child or children, or access rights to them.
If you are applying on the basis of your relationship with more than one child, please photocopy this
Section and complete the details for each child separately and enclose it with this form.
I think we leave this section blank? as im applying as partner to person settled in the UK.

Then section 3 says:
SECTION 3: CHILDREN UNDER 18
You are required to provide details of any children under 18 who are living with you in the UK, and who are
applying for indefinite leave to remain as your dependants.
If more than 2 children are applying, please give their details on a photocopy of this page, enclose it with this
form, and place the photographs in a sealed envelope attached to section 1 as instructed there.
Do we skip this section too? If yes then how about Question 3.1 it says:
Do you and your partner have any children
together?
And yes we do, we have 2 do we answer this section or not?

You need to complete Section 3 as appropriate and whichever questions are relevant.

So am guessing your answers would be as follows.

3.1 YES
3.2 NO (assuming they are your/partners children born out of the marriage and not 'step children')
3.3 NO (assuming partner has no children from previous relationships)
3.4 Depends on answer to 3.3.
3.6 Self explanatory and needs to be completed
3.7-3.9 As applicable or relevant. If not, leave blank.

Section 8A Financial Requirement it asks:
8.3 From the list below, please indicate the financial source(s) and the amount of income you and/or your
sponsor wish to rely on to meet the minimum income threshold.
Income from salaried employment: - complete section 8.3A
Current annual salary: £
Indicate which option you are relying on: category A or category B
Sponsor got a pay rise on June's salary payment so thats the income we add here correct, I don't work. (we have the promotion letter from he's work).

We apply under category A right because he has been with company he's working for since 2009.

This question is very vague:
If you or your sponsor have had more than one job, you must provide the full details for each job held and
the specified evidence for each job.
You and your sponsor’s total combined income from salaried employment?
He only works for one employer since 2009, we still put he's current salary here (after promotion) as its our only income?

Don't know what is exactly the meaning of this question, is it things like rent, food, clothing and kids stuff?
Section 6 BRP it asks:

7. Have you had your fingerprints taken as part of a previous United Kingdom immigration
application made in the United Kingdom or abroad?
8. Give details when your fingerprints were taken:
9. Give details where your fingerprints were taken, including the town or city and country:
10. Give details of the British diplomatic post(s) involved if the application(s) was/were made abroad:
These ask about my last BRP right, so for:
7. Yes
8. don't remember the date but it was december 2015, is that ok
9. I have the post office address i did
10. do i ignore this question?
When combined does your annual income and your sponsor’s annual income from current employment
meet or exceed the minimum income threshold you must meet?
Yes
You or your sponsor must have been employed by the same employer for 6 months prior to the application and your combined total earnings must meet the specified amount at 8.3A (xiv) for this 6 month period. If not, does you and your sponsors income from salaried employment received in the 12 months prior
to application meet or exceed the minimum income threshold you must meet?
It's Yes or No question, not sure what to tick? My sponsor has been with the same employer since 2009.
SECTION 8B: MAINTENANCE
You must complete this section if:
(i) You were granted leave to enter or remain as a partner under Part 8 of the Immigration Rules following
an application submitted before 9 July 2012.
(ii) You are applying as a partner under Appendix FM and you qualify for an exemption from meeting the
minimum income threshold element of the financial requirement.
(iii) You are applying as the parent of a child who is settled in the UK.
You must provide evidence that your sponsor (or you if you are applying as a parent) is able to adequately
maintain you and any dependants in the United Kingdom without recourse to public funds.
All applicants must provide specified evidence set out in Appendix FM-SE of the Immigration Rules unless
they have had leave under Part 8 of the Immigration Rules before 9 July 2012. For further details see
SET(M) guidance notes.
Do we have to fill in this section?

This is the same question and we tick passport again, correct?
