When to apply for ILR

Can someone please help me. I am a British citizen from birth. My wife entered the UK on a spouse visa on 14th September 2013. We applied for FLR(M) in April/May 2016 and received BRP for further leave. BRP card says date of issue 15th June 2016 and valid until 01 January 2019.

My question is when can I apply for her Indefinite Leave to Remain. She entered UK on 14th September 2013 so after 14th September 2018 would make it 5 years. Can she apply then or 28 days before her BRP expires which is 01 January 2019? Please clarify someone.

She can apply at any time WITHIN 28 days before 14th September 2018.

Thanks CR001 for your prompt response.

One last question to tag on to this. My wife has been on a couple of holidays. Once for 4 weeks and then other time for 7 weeks during her time here. Does that matter? Do they calculate that when look at the 5 year stay?

There is no absence limit for applicants on a spouse visa.

Sorry last question. So 5 years will be 14th September 2018. Is it OK to submit the SET (M) form after the 14th September 2018 or in October 2018??

She cannot apply any sooner than within 28 days BEFORE 14th September 2018.

She can apply at any time after that, it is entirely up to her/you, as long as she applies before her current visa expires.

SECTION 12 - Documents

Items of correspondence addressed to me.

Can I use Tesco Bank Credit Card statements (sent in post ) and Virgin Media broadband/phone bills. The Virgin Media phone bill is online so I can just print. Would these be ok to use as evidence that im living at my address.

Original Passport or Copy for British Child

SET(M) Application Form

SECTION 12 - Documents states that -

"Children
If you have children under the age of 18 in the UK (or children who are over 18 and who have been granted
leave in this category as your dependent), you must provide the following documents for each child:

Passports/travel documents to confirm your child’s immigration, settlement or citizenship status."

My son has a British passport. Will I need to send the original passport or will a copy be fine?

My wife will be here for 5 years on 14th September 2018. We are planning to submit application (postal) on 20th August. The last payslip I will send is dated 25th July.

Can someone confirm these dates are OK and we are in the 28 days criteria.

The date application posted is the that should be calculated for 28 days? is that correct

she entered 14th sept so application on 20th aug is valid as its within 28 days policy...
payslip also is within 28 days policy.

best of luck. i am applying ilr on 28th aug as i entered 22nd sept 2013 via premium service. i made same documents as in your checklist ....
