Long Residence ILR and ICT dependents

Hi,

Myself and my wife and daughter has visa valid until March 2021 and there are my dependants on tier 2 ICT visa.

i am planning to apply for Long Resident 10 Year route in the month of March 2021 for myself.

i am living in this country since March 2011 under Tier -2 ICT all these time( just got extended until 2021)

My wife and daughter under Tier 2 - ICT Dependent :

My wife came to UK as Tier 2 - ICT Dependent on May 2013 but left on Jan 2014 and returned back on Jan 2015 ( 12 months away from UK). Since 2015 no break and remains in Tier 2 ICT dependent.

March 2021 , Wife will be completing 6 years in Tier 2 ICT Dependent ; 8 years if you consider May 2013 first entry( but there was break due to delivery )

My daughter came to UK as Tier 2 - ICT Dependent on Jan 2015 and will be completing 6 years in Tier 2 ICT Dependent on March 2021 ( no break )

Question 1 : at the time of i apply for ILR , will my wife be eligible as she lived with me as tier 2 ICT dependent ?

Question 2: at the time of i apply for ILR , will my wife eligible to apply through any other route to remain with me if not qualified to apply with me.

If so what are the issue with her ILR eligibilty ? are there any lose of time she spent in the country?

what visa she need to apply to remain with me ? how long that visa valid for / what sort of visa that is:

Question 3: at the time of i apply for ILR , will my daughter ( under 18 ) be eligible to apply with me as by that time on March 2021, my daughter would have finished 6 years under Tier 2 ICT Dependant ?

if not what is other option so that my wife and daughter can remain with me?

1. No. Set LR does not permit dependents to apply for ilr with you.

2. Your dependents will have to apply to switch to FLR M spouse visa after you get ILR. This will reset their 5 year clock (2 x 2.5 year visas) towards ILR based on 5 years residence. You need to meet the financial requirement and she will need English A1 test.

3. No she cannot as set LR does not permit dependents. She will have to follow the same path as your spouse

1. okay thanks.very helpful information.

2. my wife and daughter visa will expires on April 08 2021 and mine on April 12th 2021. should i apply first on march 2021 and once get mine ( ILR) or we all can apply the same time with respective stream. ie myself for Set LR and wife's as FLR M spouse respectively ? Little confused if FLR M can apply the same time as i am( at the time of applying for FLR M i am not permanent resident ) how it works ?

My wife doesnt work all these time. but i can easily meet the finaincial requirement. can they show my income as they are my family/depenants?

FLR M spouse visa - can my wife work in UK with this visa ? any condition?

2. If applying in person he's you can all apply but your appointment first and dependents couple of hours later. If your ILR fails, their flr m will also fail. Or you can apply in person and then they can apply by post before their visa expire.

Your spouse can do any work on Flr M.

my wife will also be legally in this country for 10 years by 2025. can she apply through long resident route ( 2021 March she will go for 2.5 yrs FLR M and another 2.5 Years but she need to wait until 2026. isnt ?

Yes to both questions.

If your wife applied long residence ILR, you will need Set F form for non UK born child dependents after she hss ILR.

Hi,

If I myself moving to tier 2 general from tier 2 ICT due to new employer and my dependants who are still in tier 2 ICT dependant ( visa valid till mar 2021 ) do I need apply for them also again to move to new tier 2 general dependant with new employer or they can remain in same visa ?

Home office doesn't seem to pin point this in website.

They got dependant visa sponsorship from my present employer based on my visa. If I am move from this company will they cancel dependant also.
