Retain Right of Resience Refused

Dear All,

I am Dinok, first time in this Forum, I hope any expert or any one have a same relating problem as I have … please, advise me. my ex wife is French Citizen but live in UK since 2002 and Self employee since 2002. she have a one child her ex husband, I have a no child from her.

Married in Pakistan : Aug 2010
Came to UK with Nov 2011 Continuing Working Since Nov 2011
6 Month Visa.
5 Years FP issue : Aug 2012 (5 years FP) Expired September 2017

Decree Absolute Issue : Aug 2015

Apply for ROR Aug, 2015 Refused, reason ex wife not co operation for given me a Treaty right papers.

Fairly & Friend involve, and She give me a All bills since 2011 to 2017 including HMRC Treaty Right Tax Return She is a Self Employee and she still doing our Divorce Process Treaty Right, as Part Time Work because she have a Housing Benefit, Child Support Benefit, take care own child byself,

Now Home Office refused my ROR, Reason : Your Ex wife not working Full time as a Self Employee.
I told to the judge she have a lot of responsibilities with her child is a Special Care Behaveral.

Please, advise me what can I do now, do I go back home, or by Law HO remove me from UK

Your situation is complicated and complex. HO are not friendly. They won't cooperate.

Go to CITIZENS ADVICE bureau and ask for heir help to get in touch with a specialist IMMIGRATION LAWYER. Let the solicitor sort your problem. You won't be able to deal with this alone.

Yes. I call to Court after 2 weeks time, they told me you win the case, but 14 days for HO to Challenge to your case, I counting 14 days on my finger, after 14 days I call back the told me HO didn’t Challenge your case... Now I’m waiting for my Visa..... I update more when I receive my visa. Thanks for all in this forum share with me there experience. Thanks a lot guys.

Congrats I have something similar but mine was refused for not putting my ex ID as she refused to give it.. I already appealed

my advise for you, when you apply for Resident Card, you attached all documents yes. so, if you have a copy of your ex. attached or send to HO. I send to HO all my ex only photo copy as I send before for my RC. that's all my friend, only essential for Treaty Right. Thanks.

Hello, all Please, any have a similar situation or experience about ROR or Permanent leave to remain,

came to UK as a family member of EEA Nov 2011 ( 6 month visa )
August 2012 (5 years Residence Card issued)
After 4 years married decree absoulte issue july 2015
apply for ROR Refused 2016(reason ex not supporting me her treaty of right paper).
apply for humen right was refused Oct 2017.
got another chance of appeal March 2018
Hearing July 2018 is succesfull. Friends and faimly invloved with ex she give me her 7 years HMRC Treaty Right papers.


i received a letter from first tier turbunal your application was succefull HO not challenge your application. Thanks God... Now my question to any one who facing same situation or any experties how long i have to wait for my Visa and documents back? 2. any one know what kind of Visa i got? because im in legaly in UK 7 years. Should i got ROR or Should i got Permenanet Residency Card. Please Help me out this stress now. Thanks.

I would like to ask you what did you do to solve the issue of not having ex ID, i am in the same situation tho as my partner is not agreeing to talk to me since we end up on bad divorce.

Hi Dee, you can talk to your ex trough any closed friend and family, involve her close friend, she definitely she is human .. try every effort, I guarantee she give you a id. good luck.
