Tier 1 PBS Dependant - When she is able to apply for ILR?

Post by skreddy » Fri Mar 30, 2018 11:41 am

Hi All,

I am on ILR, my wife is on PBS dependant visa which expires on 8th Dec 2018.

She first came to the UK 16th September 2013 on PBS Dependant visa. ( EC dated valid from 26th August 2013 - 08th November 2015).
Then extended on 8th Dec 2015 same PBS dependant visa (applied on 1st November 2015, postal application) and valid for 3 years till 8th Dec 2018.

Can somebody who knows, please confirm me...
Is she able to apply 28 days before of 26th August 2018 or 16th September 2018 or 8th December 2018?

She was out of the UK twice, is the absence okay?

1. 30th Oct 2014 - 29th April 2015 (180 days exactly excluding flown out/in days)
2. 29th April 2017 - 20th August 2017 (112 days)

Thank you.

Thanks a lot Casa for the valuable information.

Is there any funds maintenance/affordability proof need to show for the PBS Dependant ILR?
Like bank statements for 90 days.

She is not working, I work, what to answer for the question Is any one fiend or relative regularly give you money if so how much?

What to put for this question. Normally we share all the money I get.

Thank you.

You need to show adequate maintenance:
Section 12 Documents > Your Finances
For all applicants except those applying in the bereaved partner category.
Evidence of your finances. If you have to complete section 5, bank statements, building society savings book(s), pay slips or other formal documents as evidence of your ability to maintain and accommodate yourself and any dependants without recourse to public funds. See Note 4)

Note 4:
If you claim that a relative or friend is providing you with financial support (see question 5.4), in addition to evidence of your own financials, you must provide bank statements or other documents of the kind described above as evidence of their financial resources. The documents showing the financials available to you and to any person supporting you should cover at least the last three months.

She is not working, I work, what to answer for the question Is any one fiend or relative regularly give you money if so how much?

What to put for this question. Normally we share all the money I get. See note 4 above and clarify in the further information section.

Thank you.

ILR - Earliest date to apply?

Post by skreddy » Wed Jul 04, 2018 10:27 am

Hi,

Please somebody help...

My wife's dependant visa was issues on 26/08/2013 (valid from) and she came to the UK on 16/09/2013.
Can please somebody confirm, what is the earliest date she could apply for ILR, is it 28 days prior to visa issue date on completion of 5 years i.e. 29/07/2018 or 19/08/2018.

I am thinking it is 29/07/2018, since the new rules in place from January 2018.

Thank you,
SK

Hi
Sorry, I am a bit confused and would like to clarify, I remember reading you mentioned in another post yesterday that ILR (LR) can only apply within 28 days of entering date(NOT Visa issue date). Does that mean different routes of ILR application have different earliest dates to apply?

I am applyinging for ILR (10 year route), my first visa was issued in 8/28/2008, and I arrived in UK in 9/17/2008, which date should I base on to count 28 days before?

Many thanks for your clarification.

Your ILR LR query has absolutely NO relevance to the OPs questions regarding ILR based on 5 years PBS route residence, where the rules are different than those for Long Residence. Please start your own topic or continue in one you already have.

It is different for LR and for PBS 5 yr route. LR 10 year is based on date of entry. PBS 5 yr is based on visa issue date.

ILR - SET O application doubt?

Post by skreddy » Tue Jul 24, 2018 11:57 am

Hello all,

I have a doubt in filling the SET O application.
I am on ILR, my wife going to apply for ILR next week from PBS Dependant category.

I assume Main Applicant means herself, but can't see anywhere in the application about the partner/husband/wife details at all(i.e. my details, she is my dependant).

As she is not working, I am providing my Payslips,Employer letter and Joint bank account statements and both of us Lifetime ISA savings statements.

Do I need to send my passport and BRP as well?
Do I need to provide any sort of covering letter?

Many thanks,
SK

Yes, she is the main applicant. No your details not required in form. HO has this information as her visa is dependent on you.

Yes fine.
Do I need to send my passport and BRP as well?

Copy is fine.
Do I need to provide any sort of covering letter?
No.

Hi All,

I am going to apply for my wife's ILR in PBS dependant category.
All the documents are ready, a final question, her first entry clearance was issued on 26/08/2013 (valid from on visa), so can apply 28 days prior to issue date.

I am planning to send application on Monday 30/07/2018 in Royal Mail, is the application date okay for this date? I mean within eligible 28 days.

Thank you,
SK
