ILR Application

Post by biniks » Fri Jul 27, 2018 4:10 pm

Am currently on a Tier 2 General migrant visa and now eligible for ILR having been in the UK for the past 5 years (22nd July 2017reached my 5 year stay in the UK). My wife joined me in the UK in Nov. 2014 i.e. 1yr 4months latter. Along the way we had a son born here in the UK in Oct 2016 and both my wife and son are on Tier 2 dependant visa. With the exorbitant fees for the 3 of us £7,5k, am thinking of applying for myself first while I raise the remainder for my dependants and apply at a latter date.

My question is, if I do get ILR, will their Tier dependant visa not be revoked as I will no longer be on a Tier 2 visa? Is it possible for them to continue to a point where I can raise the required funds and then apply for their ILR then, even before their Tier 2 dependant expires?

Please help!!!

Your swift ony qualifies for ILR in 2019, 5 years residence, so she cannot apply now anyway.

No Thierry visas will not be revoked. The rules allow them to continue on the existing visa route till they qualify for ILR.

Your UK born child does not need ILR if you plan on registering him as British once you have obtained ILR.
