Confusion regarding certain queries in ILR application Set (O) form

Hello everyone,

I am currently on my Tier 2 (General) visa and would be due to apply for Indefinite Leave to Remain (ILR) along with my wife in the next few weeks.

I have been looking for solicitors and considering the high prices quoted, was advised by a lot of my friends to do the application myself, referring to the forum on this website. I must admit this forum has indeed cleared a lot of my doubts and hence I have decided to do our application without any solicitor assistance.

I downloaded a Set (O) form and have few queries which I would really appreciate if someone can help me with, as I couldn’t find any answers to them in the previous posts or on the internet.

I do apologise in advance, if any of the questions below seem trivial.

Under Section 3 – Which category?
As I am currently on Tier 2 visa and my wife on Tier 2 Dependant visa, under this section, I need to put a tick next to just Tier 2 Migrant or should I also put a tick next to Tier 2 dependant for my wife.

Under Section 5 – Your Home and finances
Currently, me and my wife live in a shared Ownership apartment, wherein we pay mortgage on 25% of the flat and rent to a housing association on the remaining 75% of the house.
In this scenario, should we select the option, ‘Owned by you?’ or ‘Rented from a local authority or housing association?’

And since we pay both rent and mortgage on the house, should we write the total payment made every month in the next question?

Under section 5.6, where the form asks about the ‘Number of hours this salary is based on’
According to my employment contract, I work 35 hours a week, so should the numbered of hours be calculated for the entire year excluding bank holidays and paid leaves?

Where can I find the rate of pay for SOC code, my current gross salary (excluding bonus and overtime) is £36,500 and my SOC code according to the CoS is 2136.

Under Section 6 – immigration history
For the question 6.1, as I applied for Tier 2 visa whilst I was in the UK on a different visa (PSW), should I mention the date when I first entered the UK as the date when I initial Tier 2 visa was issued?

Similarly, for question 6.4, please correct me if I am wrong, where the form asks when did I last enter the UK, would be the day from when I travelled back from overseas recently, is that correct?

For question 6.12, my wife had also applied for a dependant Tier 2 visa along with me from within the UK, so the date when she first entered the UK would be the date of issue for her first Tier 2 dependant visa, is that correct?

Under Section 7.14, where I need to state the social, cultural and family ties
Should I just mention about my parents and extended family living in India?

I might have more (follow-up) questions but if anyone of you who has been in the same boat as me, can help me figure out these answers, I would be really grateful.

Once again, I apologise for the long list of questions, but any help would be highly appreciated.

Tier 2 migrant as you are the main applicant

Under Section 5 – Your Home and finances
Not 100% sure but since majority of the house is rented, i'll tick the rented option.

Under section 5.6, where the form asks about the ‘Number of hours this salary is based on’
hours per week x 52

New entrant: £24,000
Experienced worker: £32,000

Under Section 6 – immigration history

just immediate family should be fine

Although, I am still concerned about the question for Home, as I couldn't find any answer with people in the same situation like us.

Just wondering, if anyone has gone through their successful ILR application with being under a Shared Ownership scheme? Do you think it will be worthwhile to start a new topic for this question?

Hello everyone,

I have just posted a new topic yesterday (indefinite-leave-to-remain/confusion-re ... 60405.html) regarding few doubts on Set (O) form and someone has been really kind in answering most of the questions, except one, which even the person was not sure about.

I tried to find answers on other topics related to Shared Ownership queries but didn't find a definite answer and also couldn't find any answers on google.

Basically, based on my research it is confirmed that a Shared Ownership house/flat is not related to public funds, so that is clear.

However, in the Set(O) form, I could not find any proper answers from people with a successful ILR application, if they selected Owned a House, Renting from Local Authorities or ticked both these options or for that matter selected Others option. And if they selected Others, what did they mention in the description box below.

Can someone who is in the same position as me and who had a successful ILR application, help me out. I am sure there will be many people who would face the same situation now and in the future with Shared Ownership Properties.

Apologies for creating a new topic, but felt as there are very few posts and information about Shared Ownership Properties on the forum, so it can be made as a separate topic.

As a new member, I am really not aware of the rules and regulations here, but if merging my queries into one topic make it easier on the forum, then I am happy with it.

Just as long as someone can help me out, really confused with these applications :-)

With respect to shared ownership, You can tick both and include the total amount you spend on rent + mortgage monthly. You can then include a cover letter explaining your situation. I think one of the most important reasons for this section is to determine how much you earn and how well your expenses fit into your income and to demonstrate that you can comfortably look after yourself and your family after your ILR has been granted. So I don't think HO/ UKVI will care so much about shared ownership, they just want to know how much you spend on housing monthly.

I have been doing a bit of research in the past few days and since there is very limited resources available with regards to this topic, I have decided to get my application done through a immigration Specialist, just so I can have peace of mind and doubly sure.

Has anyone of you tried [[name removed by moderator]] here in London? I could see a topic about them on the forum but it from a few years ago. Anyone used their service recently?
