Switching Tier 2 ICT to dependant Tier 2 general visa travel question

Post by raarora » Sun Aug 05, 2018 10:33 pm

Hi,

My husband and I entered UK in July 2016 on Tier 2 ICT visa and his dependent respectively. I worked for around 1.5 years on ICT dependent and then i got the sponsorship from different company and they applied my Tier 2 - General. I got my tier 2 general in June 2018. Now my husband is applying for Tier 2 - General Dependent which is expected to come by the end of September 2018.

Can you please confirm if my husband can travel outside UK with his old BRP (T2 -ICT) while we wait for the new one to come along. Thanks.

1. Did he not submit his passport with his application?

2. Is he still working for his ICT sponsor??

3. Is his ICT visa still valid??

4. Kindly regain from tagging your question onto other members topics.

(He has submitted his passport and current BRP which is expected to come back in a week or two, But visa approval and new BRP will take around two months)

2. Is he still working for his ICT sponsor?? (Yes,he is still working for his ICT sponsor and he has informed them for this visa change and they are ok about this)

3. Is his ICT visa still valid?? (His visa is valid till July 2019 and so is the BRP)

He will likely only get his passport back once a decision is made. If his new visa is granted, he won't get his old brp card back as the ICT visa will be cancelled.

It does not work like that. They return the Passport and old BRP in one or two weeks time.

We have already received his Passport and BRP back. Only confirmation we need is whether he is allowed to enter UK back with the old BRP.

So, it looks like that the application is already in process. If his dependent application is not decided by the time he's re-entering UK, it's fine. However, if its decided and is successful, his old visa would have been cancelled and he will not be allowed on his old BRP. You need to decide if it's worth taking the risk.
