Spouse visa

Post by iappiah » Sat Aug 11, 2018 9:50 am

Hello,
Can you please help me?
I married my wife in 2010 while she was on student visa and I was an overstayer. We have two children one is 12 and the other one is 10 now. She got her indefinite leave to remain on students 10 years route and I got my visa, 30 month in Mar 2015 based on my children and my wife's visa but it wasn't a spousal visa.
I changed my visa to a spousal visa in Sept 2016. I was given 30 month till June 2019. Am due renewal in June 2019. Please can you let me know how many years I've got left to apply for indefinite leave to remain? We are all in UK now
Thank you
Isaac

I suspect that you are on a ten year route to ILR. You may be able to switch to the 5-year FLR(M) route if you can meet all the requirements.

Hello,
Thank you for the reply.
No, I am on a five years route because I changed to spouse visa in 2016 Sept. I spent 18 months on my first visa before switching to spouse visa. Will my first 18months count as part of my 5 years duration?

If you had valid leave and switched in-time and satisfied all requirements for your initial FLR(M), then your 5-year qualifying period for SET(M) would have reset from the grant of your initial FLR(M).
