Our cases are completely different so I don't think telling you the details of mine will be of any help. However, your case seems to be a strong one and I'm sure will be a success if your legal team is of a good enough standard. I would recommend really getting involved and asking questions ect ect and if they are unwilling to awnser question or are being difficult or just not putting you first or their full effort into the case - just get rid of them and find someone who will as this is your life.

just wanted to know if you have your BRP after allowed appeal in july, my appeal was allowed in october and home office is not going to challenge the decision, when i rang home office on 6th november i was told that my file had been sent for visa processing, please let me know so that i can have a timeframe in my mind

21/05/18- Court Hearing
26/06/18- Determination letter received(dated 19/06/18) Appeal Allowed under Immigration rules and Human rights.
18/07/18- BRP recieved(dated 16/07/18)

90 days already passed since my appeal and still waiting...a bit worrying now, I hope they didn't lose my documents. It is more than 2 years since I applied for residence card, my passport with Home Office all this time.

i have my own post but thats about another Issue just wanted to ask my appeal was allowed on 18th of July from Upper Tribunal and its now 13 working days still worried if HO going to appeal or not.
after Sucessful appeal how long they going to take to send implementation letter ? min or max time ?
and if they not sending any letter shall i ring them to check updates ?

Normaly it take 5 to 10 days to Receive confirmation letter and it depends on Area i was in Manchester so my appeal was quick with in a month but some of my friends told me that in London it take 2 to three months im telling about FTT appeal

Hi Everyone

I am a silent member of this group. I applied for ILR long res in Nov 2016 and was refused due to gap over 180 days in 2008 due to illness. Caseworker failed to apply discretion with respect to the evidences produced at that time. I was given right of appeal and had my hearing on Nov 2017. Finally my appeal was allowed by law with more evidences to my case. Received judges determination on first week of dec 2017. Right.. after that I've received implementation letter from the post decision unit on the 18th Jan stating that the judges decision will be implemented and not to have any travel plans as I can understand as a general format.

In mid of march approached through MP thinking that the waiting time is 12 weeks since the date of promulgation. I've received a response in mid April stating that it is under consideration and will be notified when the decision is made. The letter also says there's no specific time frame. Now it's been over 8 months since my appeal was allowed I am still waiting for my documents and brp. Last week I approached MP again to find out the progress on my application.

Members is anybody still waiting for documents and brp with over 8 months since the appeal was allowed? Apart from Awon51214 who received after 9 months.

Members your feedbacks be much appreciated

Refusal letter received: 22/09/17

Appeal lodged to FTT: 02/10/17

Appeal Hearing date: 26/06/18 (Hearing adjourned for a later date on the request of Home office presenting officer)

Appeal heard: 13/07/18

Judge decision: 25/07/18

Case determination received: 27/07/18 (Judge allows the Appeal on human right bases and orders to refund fees) HO has 14 days to appeal.

Court appeal fees refunded to my bank account: 07/08/18

The wait continues.....

Wow you are quite lucky, took the judge 1 month 2 weeks and 3 days to send the determination letter. I went to court on May 14, 2018 and didn’t hear from the Judge until the 5th July 2018 (letter was dated 2nd July).
My fees were returned on the 25 of July and my solicitor received the Implementation letter dated the 25 July also.
Now I’m waiting and praying that my passport be returned soon and I get my BRP. My passport will expire sometime this month and I was planning a vacay to DR but it’s an hold until I have received everything.
Hope you don’t have to wait too long and get your documents and BRP soon!

Remember this is a wait game. Dont give up. you will receive your passport before the brp. BUT sometimes the brp comes before the passports. Fingers crossed

No I haven't received any implementation letter yet. I am expecting it to arrive within a month of the actual appeal decision. So say by 25th of August Inshallah!

By the way dont stress out about your passport getting expired. Mine gt expired in October 2016. Just relax and enjoy the sun 8)

I received my BRP finally after long. Below is my complete timeline.

Goodluck All.

ILR Applied under 10 Years Long Residence at Croydon PSC (same day service) on 15 November 2016.
Additional documents requested on the same day by the HO within 14 days.
Documents sent by post within 14 days.
Interviewed attended at Croydon on 03 May 2017.
Application refused by the HO 16 MAY 2017.
Appealed against the refusal within 14 days.
FTT hearing listed 13 Feb 2018. (Birmingham)
1st request sent to FFT for early hearing, which later listed for 11 Dec 2017.
2nd request sent to the FFT to bring hearing forward confirmed hearing on 03 Nov 2017.
On the day of the hearing, my bundle was not delivered to the HO so they requested to adjourned. The judge adjourned the hearing until 18 Dec 2017.
Hearing attended on 18 Dec 2018, no one came from the HO.
Appeal allowed 18 Jan 2018.
PDCU acknowledgment letter received 04 Feb 2018 dated 31 Jan 2018.
MP letter sent on 12 Feb 2018, 28 Feb, 22 MArch.
Letter sent by the solicitor on 26 Feb 2017, March, April, May no reply from the Home Office.

Complaint launched to the HO on 18 June.
BRP RECEIVED 22 JULY 2018. Unfortunately, the HO lost my passports submitted with the initial application.

After long now in peace.

Congrats on your BRP. That's wonderful news!! My case is exactly similar to yours. Can you please confirm you got ILR which u had initially applied for or any other visa? I am asking because HO is issuing 2.5 years visa in certain similar ILR cases which have been won from FTT on Human Rights bases. (My appeal was allowed on Human Rights bases.) So kindly confirm you gt ILR?

Just a quick update.my lawyer called me earlier and said he has received my passports and a letter from the HO stating that they have processed the courts order and have issued me an ILR. They also said that I shall receive my ILR within 2 weeks. So I think by the grace of almighty Lord Allah, the KING of kings has accepted my plea and have granted me what I requested him. May he grant you all out there what you are looking for and May you all get your visas quick. I will be updating you all on this forum till I receive my BRP card which shouldn't really take 2 weeks. (Normally it arrives within 3 to 4 days) Good Luck you all!

Thank you so much whenwillthewaitbover I know how every one feels in such situation. I've been in it my self. It's ugly but one should never lose hope .Be positive and let positivity surround you. See I never really thought too much about it. As u rightly mentioned in your previous post u can't do anything about stuff that's not in your control. So just pray to God that you get through it. Put some deep house/lounge music on, renew your netflix, and get some popcorn. And wait for the right time.
