Hi,
Wondering if anybody could advise. My son was born in indonesia in August 2006 to my Indonesia wife. We were not married at the time so my name did not appear on the official birth certificate.
We married in 2010. I am a British citizen by birth 1970.
I recently applied for a UK passport for him but was rejected as they said he appears to be indonesia citizen based on not being married at the time and my name not on the Birth cert within 12 months of birth. I was wondering if I could 're apply for the passport but this time include a UK accredited DNA test which i plan to take next week, Would this be acceptable as it was not done within the first 12 months of the birth. If not do I have to take the nationality MN1 route section 4F (3)1 first?
We live indonesia and are staying for awhile as yet,
My son and my wife both have Indonesian passports.
I was thinking maybe as he was born after the July 2006 law change he has an automatic right to British citizenship/passport even if I put in a late DNA test.
Appreciate any advice.

Can I get UK passports for my 2 children born abroad or do they need to apply the nationality route first.

Hi,
Just wondering if you could advise please. I was born in the UK 1970. I am currently residing in indonesia and have 2 children here born to my wife an Indonesian lady.
One child was born in March 2005, the other was August 2006, both born in indonesia. We were not married at the time so my name did not go on the Birth certificates, we married in August 2010. I have approved DNA certificates taken this year for both children.We are currently trying to get new birth certificates with my name included.
I know the law changed in August 2006 regarding marriage requirements but does not having your name on the Birth certificate within 12 months still cause a problem? With the information/documents mentioned above can I apply directly for passports or do I need to go via UKF and MN1? I was expecting to give them automatic citizenship by desent with above docs.
I am still domiciled in the UK and have a perminent address there.
Any help much appreciated.

If they recognize you as the child’s father, then the child is automatically British.

Section 47 applies to elder child.

Thanks for your reply, regarding 47, does it basically state that my eldest child (2005) has become have a British citizen after the date of my marriage August 2010 by desent as I am British otherwise by desent?

Re Section 47, from the date of the marriage, he should be treated as if being born legitimate, and therefore British by descent from birth.

A question on the UKF form, it's states the it's for someone born before July 2006 if the parents were not married, do they mean married at the time of birth or never married to each other?
