Going Abroad on a Spouse Settlement Visa (i.e. before ILR)

Post by raukodur » Tue May 13, 2008 3:02 pm

The matter in question is of person with a spouse settlement visa leaving the UK for a period of time to go on holiday before the 2 years is up and an application for indefinite leave to remain has been made.

The specifics of the situation are that this summer my family wishes to go to Saudi Arabia for a duration of 2 (between mid June and the first week of July). My wife's settlement visa ends near the end of October.

I thought it best to contact the home office, however that has just left me confused, since I was under the impression that on a spouse settlement visa there will be a specific period of time for which a person is allowed to the leave the country to go on holiday, however, the clerk who answered my phone said there was no such thing, that the settlement visa did not put any restrictions on foreign travel, but that a requirement for the indefinite leave to remain application was "2 continuous years of residence within the UK", and that he could not give me any further information about an application that had not yet been made, and that if someone did go on holiday, it was up to the officer judging the application to make any further judgeements.

From this I am left with the impression that no travel abroad (unless for very important reasons, e.g. death of a relative and so attendance of a funeral) is really permitted before indefinite leave to remain is granted, since it can jeoperdise the application.

Is this the case?
