Overstayer married to a British National with a British child

Post by Kiwibob » Fri Aug 17, 2018 9:34 pm

Hi,
I arrived in the Uk in 1999 on a ancestry visa, had to renew my passport at NZ House London and was given a stamp in my new passport "Given Indefinite leave to enter the United Kingdom". Never had a problem with leaving or entering the UK since, for work or holiday, never been out of the country for more that 2 weeks at a time. Just had to apply for a new passport and they would not transfer this stamp. Now having to complete another DBS check they are stating i need to have Biometric Residence Permit which i will not get i don't think. I have not contacted the home office as yet until i get some advice from someone hopefully in here. Im a NZ national married to a British lady since 2006 and we have a child born in the UK in 2011. I have worked since i have been here and never claimed benefits, I'm the main income earner in our house hold with my wife working 2 day a week. Any help advise offered will be much appreciated.
Cheers

Why do believe you won't get a biometric residence permit?

Why do you think you are an overstayer?

Who stamped your indefinite leave to enter in your new passport?

Tanks for your response. Ancestry visa usually last for 5 years. i did do paper work when i applied for my new visa but I can't remember what it was as it was for as so long ago. NZ house in london gave me the stamp. Last thing i need is for the HO to stop me working and kick me out as this will stuff up my family

Agree with Char, should be alright.

Form NTL should do the trick.
