hello,
am an overstayer,i came with a six month visa 7years ago and didnt go back when it expired, married to a british citizen and we have a 13month old baby that is british citizen as well, the problem is we have been having problem lately and i have decided to get a divorce and go back to ghana with my child, but he didnt want that to happen, he wants me to leave my child behind,
does anybody have any idea if i will be allowed to go go back to ghana with my child, since i dont have no rights to stay here,

Your question is not an immigration problem. The real issue is the custody of the child. Seek professional legal help as the question of custody and then removing a child from the country is a difficult one.

Your overstayer status will not have a great bearing on the matter.

From the child’s point of view - were they born in the UK? If so they have a right of abode and access to a British passport. At the same time you might have a right to remain with access rights to the child.

On what basis are you an overstayer?
