Tier 2 General 5 years route to ILR

Post by Mike2018 » Thu Sep 13, 2018 12:02 pm

Hi All,

I have a query regarding my ILR application. Can someone please answer and suggest me what to do.

I am on Tier 2 General VISA with an employer named A for the last 4 years 8 months. I am eligible to apply for my ILR coming December 24-12-2018. I have switched to Tier 2 General from PSW on Jan-2014 and my current VISA is going to expire on Jan-2019 but my payroll started generating from March-2014 which means out of 60 months ( 5 years ) I don't have payslips for 2 months Jan-2014 and Feb-2014 and my employer didn't pay anything for those two months, is that a problem when I apply for my ILR.

In Short, out of 5 years I don't have payslips for two months, just wondering if I go to ILR this December, would that be an issue if HO checks last 5 years ( employment with A ) payslips.

Thanks in Advance,
MikeG

If you were granted Tier 2, why weren't you paid those 2 months?

Although for ILR application you need only the most recent month's payslip.

But anything can be asked to verify and might ask for those missing payslips too.

You might get away with it if you have a valid reason and if your employer can give a letter of some sort explaining that.

A member was recently refused ILR due to non payment of salary for a few months in the beginning of his TIer 2 journey.

HO do check your HMRC records, so be careful.

Even though my employer sponsored me from Jan-2014 but I have actually joined the company on March-2014.
