Tier2 to Tier4 Student

Post by Dilliwalah » Sun Sep 16, 2018 3:44 pm

Dear All
I need some advice on my chances of getting tier4 student visa and ILR via 10yr route.
1st leave - May 2010 to Feb 2015 - T2 ICT - Date entry to UK Jun 2010
2nd leave - Mar 2015 - Mar 2020 - T2 General - No break

I want to apply for tier4 student visa and pursue higher study. Can someone advice my chances for getting tier4 visa? Since i will be due ILR via long route in Apr 2020?

Any advice would help. Current sponsor is undergoing redundancy, i am not impacted but want to plan ahead.

Please help and advice!

Regards

Long residence ILR residence qualifying period starts from the date you ENTERED the UK and not your original visa start date, so no you will not qualify in April 2020.

Note that your dependents cannot apply with you on Set(LR) for ILR, they would have to switch to FLR(M). You don't state how long your dependents have been in the UK either.

Thanks a lot for your reply. Entered UK Jun 2010. Spouse entry Oct 2015.

If i convert to 2 yr degree program starting Jan i would be able to qualify for ILR in Jun 2020?

All visa categories count towards ILR based on 10 years long residence, provided that you do not breach any of your visa conditions.

Your dependents will have to switch to FLR(M) if you apply for ILR based on Long Residence and meet the English and financial requirement. Her clock towards ILR will also be reset to zero (2 x 2.5 year FLR(M) visas) before she qualifies for ILR on Set(M), unless she reaches 10 years long residence herself before that.

Thanks a lot.

If my sponsorship is cancelled and i have to go to home country to apply tier4 visa. Will that ruin my chances for ILR?

If you leave the UK before your visa expires and return to the UK within 180 days, then continuity of residence is maintained.

If sponsorship is cancelled due to redundancy will it mean visa expiration?
My current leave expires in Mar 2020 but since t2g is linked to sponsor i am not sure.

Sorry for so many questions and thanks a lot for your patience

Your visa will be curtailed to expire in 60 days, counted from the date you get the curtailment letter from HO.

Thanks for the advice.

For eg if Visa is curtailed to expire on 1st Jan 2019. I receive my tier 4 visa from 10th Apr 2019.
Will i be OK for 10 year route?

Thanks again, sorry for my lack of understanding.
