Wrong address on COS

Post by faridsmailbox » Mon Sep 17, 2018 10:20 am

Hi All

I need help on below matter.

I am on tier 2 general visa and my visa is expiring on end of October. My employer has assigned me a COS to extend visa and I have found out that my current home address on COS is address as per my passport which is my address in India instead of my local address in the UK.

I asked my employer to assign another COS but they said they do not have another certificate to assign and said that they would add sponsor notes with correct current local address.

My question is that if they add sponsor notes with correct address, will this be enough or would this mistake be classified as a major mistake.

I am confused, please advise.

Thanks

How to amend details entered on an assigned CoS
Minor error

You should use the ‘sponsor note’ field to amend minor errors identified after a CoS
has been assigned. This could be to put right a mistyped name or date of birth or to
change the start date of the job.

You can also use the ‘sponsor note’ field if there is any additional information that
you need to state with regard to the migrant and/or the CoS. For example, if the
CoS is for a Tier 5 (Religious Worker), you must explain how the resident labour
market test has been met by adding a sponsor note.

A ‘sponsor note’ can only be added to a CoS that is showing in your SMS account
with an ‘Assigned’ status.

Significant error
You must cancel a CoS and assign a new one if you have made a significant
error such as:
 the SOC code is wrong
 you have assigned it under the wrong tier or category
 you have given wrong details for more than one of the below:
o the migrant’s nationality
o the migrant’s date of birth
o the migrant’s surname

Source: Create_a_CoS_-_guide_for_Tier_2_and_5_sponsors_-_Apr_2017.pdf / Creating a CoS: guide for Tiers 2 and 5 sponsors (SMS guide 8A) - version 04/17
My advice is based on personal research/experience, so pls check relevant UKVI sources.

Dear srsw

Thank you for your reply,I have gone through guidelines and it does not say anything about error on address. Would this error be counted as significant or minor error?

Thanks

If everything else is accurate, then I think (best guess) they would consider it as a minor error.

Address is generally something that can change so typos/errors on that shouldn't be a significant error, tbh.
My advice is based on personal research/experience, so pls check relevant UKVI sources.

My worry is that address on my cos is my home address in India, my HR used my passport to assign COS hence she ended up typing my address in India. Would case worker not think that my employer does not have proper record of my local address and reject my application.

I think you are overthinking what the case worker may think. As long as your employer use the sponsor note and clarify that they mistakenly used the address in the passport rather than local address, it should be all fine.

The sponsor note is to correct such mistakes (as the guide says) so try to relax.
My advice is based on personal research/experience, so pls check relevant UKVI sources.

Suggest stop overthinking. The concerns you have raised can be noted on the SMS system as all the members who posted have advised!!

Dear CR001

Thank you for your reply

Apart from correction in address can my start and end date also be amended through sponsor notes?

They have entered below start date and end date

Start date: 29th Oct 2018
End date 28th Oct 2020

Can they change end date to 28th Oct 2021 through sponsor notes so that my extension is for three years instead of two years?

I am bit nervous about above two changes which needs to be made on my assigned COS

Thanks
