ILR (M) - Due to confusion in need of help

Post by marksy30 » Thu Oct 04, 2018 12:53 am

Dear All,

My wife needs to apply for ILR. Everything i believe is in order. ie Life in uk test passed, income threshold combined passed.

I am just a little confused.

When are we supposed to apply. My wife came to the UK on first part of visa in August 2013 ( 5 year route) and has now been living here over 5 years. The BRP expires mid November. Are we ready to apply within the qualifying period?

Income: 8.3 which category do we tick A or B? and in current annual salary do we right the combined total?

We have children who both have British passports do we need to fill in:
Section 2C
Section 3
Section 8B

There is a checklist headed Children, do I have to provide passport etc for them.

Consent 13 is this me the spouse?

And lastly the property I live in is my parents. We have no household bills in our name. Do I provide council tax etc in my fathers name. Also do I still need to provide photos of property and full detail ie how many rooms etc

Apologies for all the questions, really hope you guys can put me at ease. I have done these applications for over 8 years. This one has completely thrown me (might just be the stress). There doesn't seem to be a step by step guidance anymore, which simplified the application. Sorry if my questions sound stupid.

Thanks in advance

Kind regards

Same, done applications for 10 years- this one threw me too. I have recently applied. I was under the same confusion. There is so much that seems it doesnt apply to partner route but its not clear in the form, so I didnt know what to do. Which is why i ended up applying online. The questions are straightforward and as you answer them they get customised to you and in the end you get the list of documents you need to send specific to your case.

There is some speculation that online forms are not being processed as quick but I think its case to case and timing (to do with all the changes going in october)

As for when to apply -again I was in a similar situation - completed 5 years in this category in august but visa expired in october. On the safe side I applied within 28 days of current visa expiry. Heard seem people got rejected for applying too early and didnt want to take the risk.

Hope that helps

No need for duplicate topics asking the same question!!

She could have applied in August already. Anytime within 28 days before the 5th anniversary of the date she entered the UK.
