(Spouse Visa) - Will this be called deception?

Hi, sorry for somewhat lengthy post.

I was a student in the UK for 5 years, and married my longterm girlfriend in December 2016 who was on discretionary leave at the time. She has now applied for ILR and we are waiting for the decision.

Wanted to visit wife and attend a wedding in the UK, so applied for a visit visa in July 2017, which was refused as ECO was not convinced I would leave the UK at the end of my visit.

Reapplied for visit visa again in October 2017 with the aid of a visa agency, which was refused again for the same reasons.

Here's my big concern:

In both applications, I included a letter which was an offer for employment to commence on 8th January 2017. In my second application I wrote a long letter to ECO stating how important this opportunity was for me, and that I would definitely return home to commence this job. The ECO was not happy with this letter as it was not an official contract.

However, new concerns came to light and I eventually declined the offer for this job in November 2016. Since my visas to the UK were refused, I then went on holiday with my family and wife to South-east Asia for 4 weeks. I returned home on the 12th of January 2018.

When I apply for a spouse visa later on (if my wife gets her ILR) will the ECO think that this is deception? Because they do not know that I declined the job that I was supposed to commence on the 8th of January, but my passport would be stamped 12th January (return date from my holiday)?

If so how can I prove my innocence to them? Surely it's not a crime to have a change of heart down the line and change my mind? I'm worried because I wrote that long letter stating how important it was for me to begin this job.

Any advice/ opinions would be much appreciated.

Your job (and income) is irrelevant for the purposes of a spouse visa.

Yes, I am aware of this. But my concern is regarding a claim that I made when applying for the visit visa. I claimed that I would commence employment when in fact, much later i declined the offer eventually.

My question is whether the ECO would accuse me of lying when in fact all I did was change my mind about the job. Because the offer letter stated that I would commence work on 8th of January, and my passport will have stamp for 12th of January.

Hope this is more clear.

You will almost certainly be refused any visit visas. You cant get married whilst on a visit visa anyway.

Better for your partner to go to your country, get married there, return and apply for settlement visa.

Thank you for your reply. I think there's a big misunderstanding here. I've given up applying for visit visas. I am now waiting for my wife to get her ILR approved where I can then apply for a spouse visa. We already got married in December 2016 in the UK. I left the UK a month later as my student visa was expiring.

I am just concerned that something I claimed in my visit visa application will be used against me during the spouse visa application (the details are in my original post above).

It's fine dont worry about it. An application for Settlement visa will not look into this. Once partner has ILR all the best with the application.
