ILR Dependent (UK Born)

Hi Guys,

I am on ILR and I have UK born child (6 months old now) who is in India, what VISA category should I apply so she could come back to the UK?

Further Details:
- My daughter is born in the UK, while I was on tier 2 VISA.
- She has got an Indian passport
- Due to unavoidable circumstances, we travelled to India
- Meanwhile, I came back to UK and got ILR approved
- As per this post I know I can apply for form MN1 for her British CItizenship - uk-tier-2-employer-sponsored-visas/is-u ... 56709.html
- I have been looking for ways if I can apply for form MN1 while she is in India, but I could not find sufficient details
- Now, I am looking for other ways I can get her VISA to bring her back to the UK

Any of your help will be highly appreciated.

What visa does your spouse hold?? Child apply for the same as the mother has.

My wife holds Tier 2 Dependent Visa. Which is valid untill 22 April 2019.

I am confused by the two different responses. Can you please point me in the right direction.

Now I am not sure if I should go for Tier 2 Dependent or with form MN1? I could not find the clear direction on the home office website.

You can do either as you were already advised. Tier 2 dependent will be much quicker.

It can take a few months and passport can take up to 6 to 12 months too.

Thank you for your response earlier.

Can you please point me to the official resource regarding eligibility to the Tier 2 Dependent. I am about to start the application process but could not see the documentation explaining my daughter's eligibility for tier 2 dependent VISA.

She applies for the same visa category her mother holds, tier 2 dependent.

Why do you believe she is not eligible??

And, it is pointing me to the ‘family of a settled person’ visa (https://www.gov.uk/uk-family-visa), and this is where I am confused. :(

The child must apply for the same visa category as the mother. A Settlement visa for the child will likely be refused if the mother does not apply for the same category visa.

PBS Dependant - Child visa (ILR Father)

Hi Guys,

I have started filling "PBS Dependant - Child visa" for my young daughter. Brief details:
  • Father is on ILR VISA (received on 31 Aug 2018), previously on Tier 2 General
  • Mother is on Tier 2 Dependent Visa valid until 22 April 2019
  • the UK born daughter (6 months) is in India, for whom we are making application, so she can come back to UK
Below are some of the questions within the online application, that I am very confused about:

1. Question - The person you are joining or accompanying
- I have entered myself(father) NOT my wife details. Is it correct?
- Even if I entered my wife's details, then they are asking for her sponsor's license number and
Cos, which is not valid, so I thought it should be me(father)

2. Question - Which visa is [My Name] applying for or been granted?
- Actually, I am on ILR but there is no option for ILR so I had to select Tier 2 (General) visa

3. Question - Do you have one of these reference numbers
3.1 Home Office reference number
3.2 VAF number
3.3 GWF number
3.4 I do not have a reference number for them
- I could not find any of the reference numbers on my applications so I had to choose last option
"I do not have reference number", any suggestion where can I find any of the reference
numbers on my previous application

4. Question. - What is a sponsor licence number?
5. Question - Certificate of Sponsorship reference number
- As I am on ILR above are not valid, but still, it is asking, not sure what to enter here?

6. Question - Maintenance of funds - "You must provide documents showing that you have the required maintenance funds to cover living costs for you and any of your dependants while you are in the UK."
- This is a confusing sentence as I will be providing my fund's(fathers) details, is that correct?

7. There is no question asking about mother's visa in the application, so how they will consider the child visa same as mother's visa?

Really confused, any of your help will be highly appreciated.

Hello guys,

Any advice, I am still stuck with my daughter PBS dependant VISA:
  • Is it fine if I enter my previous CoS and Sponsors license number, as now I am on ILR
  • Who will be main applicant for the application - my daughter or wife with Tier 2 G Dependent Visa or me with ILR

IHS - PBS Dependant Child

Hi Guys,

I am applying for my daughter under PBS Dependant Child category. When I am going to IHS payment it is asking me to pay £ 1336.37.

When I checked surcharge on - https://www.immigration-health-surcharg ... uk/checker it shows me 0.00 (Exempt based on child in care question) for exactly the same details that I entered during IHS payment, can you please help me, as I am not sure what to do?

PS: I am on ILR and I am making PBS dependant child application for my daughter as my wife is still on the PBS dependant visa.

Put your ILR expiry day as a shorter period, ie 3 years forward.

As of now on my biometric card it says valid until 31-12-2024, If I understand it correct I should enter 31-12-2021(which is 3 years post I got ILR)?
