PBS Dependent Visa renewal

Post by jwillaims83 » Thu Oct 04, 2018 11:51 am

Hello

Can you please help in following situation:

Wife came as Tier 2 Intra Company Transfer and then received ILR
Husband came as PBS Dependent in Mar 2014 and Dependent Visa valid till Dec 2018
Child born outside UK came as PBS Dependent and Dependent Visa valid till Dec 2018

Both husband and child will be eligible for ILR in Mar 2019 (5 year rule for husband).

However they will have to extend PBS Dependent Visa in December now by paying application fee and Immigration Health Surcharge (IHS).
  • Can they chose to apply for a short term renewal only (and pay less IHS), as they will be applying for ILR in Mar 2019?
  • What will be cost for renewal for each - £704 via 8 weeks postal route + £600 IHS + £20 biometrics?
Thanks!

A PBS dependent extension is for 3 years, as stated in the immigration rules. You cannot choose a lesser time for a visa.

Thanks CR001.

Three more questions please (apologies):

1 - Since wife came as Tier 2 Intra Company Transfer, then isn't the IHS = 0 (Exempt as Tier 2 PBS Dependent?) - Is there any way to verify this?

2 - Documents required:
- Bank statement under name of wife (showing 1260 for 90 days)
- Bank statement under name of husband (showing 1260 for 90 days)
- BRPs
- Passport
- Any other document such as marriage certificate, birth certificate, address proof (these are not listed when completing the online form, probably because application being submitted from within the UK?)

3 - Will we get email about biometric enrolment after we pay the fees? Do we have to wait for it before postage of the application?

Thanks!

1. The Ihs exemption for tier 2 ICT dependents has been removed. You will need to pay it.

https://www.gov.uk/tier-2-intracompany- ... ly-members

2. You only need one bank statement showing £630 x 2 for the dependent applications. You will also need 3 years proof of cohabitation.

3. You should be able to download the biometric letter at the end of the online process. You can do biometrics at any point once application is submitted as long as it is withing the time stated, ie 15 days.

Thanks, although I have probably a very silly question:

If I go to https://www.immigration-health-surcharg ... ecker/type [Calculate your immigration health surcharge]

I am not sure how to answer: Are you ...
  • Applying Alone
  • Coming to the UK with dependants
  • Applying to join somebody (a main applicant) in the UK
And If I chose 3rd option, what should I put as their Visa expiry date - the BRP expiry date from ILR doesn't seem right to me.

You are applying alone.

For the ILR brp expiry date, you put the end date as 3 years from now to get the correct amount of £600 each. Don't put 2024 as the end date.

Thanks! Sorry for questions...

When I select Applying alone - I don't have to enter ILR dates for my partner and IHS is coming at 0.0

If I go to the payment for IHS website, even then if I don't enter details of my partner then I get IHS as 0.0

The reason I am not entering details of my partner is based on reply posted at: https://www.whatdotheyknow.com/request/ ... rge_to_pay

I guess I will follow your advice, enter details of my partner with ILR and enter date to get IHS as £600 per person.

I have three more question please ...

1. For the biometric enrolment of an under 3 year old - Do we need to pay £19.20 as well, same as that for an adult?

2. Do we need to submit marriage certificate or child birth certificate to prove relationship with the main applicant? This was shown at the time of initial application based on which initial PBS Dependent Visa was granted and this is not asked for in the document checklist.

3. Do we need to show any proof of cohabitation or address proof with the child? I am not sure what can be shown for such a small age child...
