Appendix 2 VAF4A Section 3.3 Category?

Appendix 2 VAF4A Section 3.3 Category?

Hi,

Helping my fiancé fill in Appendix 2 of VAF4A Form. The appointment will be in November 2018.

In section 3.3 it asks
Incomes from salaried Employment in the UK (Yes, in my case)
Indicate which option you are relying on Category A or Category B

Ask - What category should I put it under?

Background - I've been working for same company for 1 year 1 month now
July 2017 to June 2018 - Contractor
June 2018 to date - Permanent

They will write me a letter confirming I've been working for them since I was a contractor.

I do have more than sufficient income to sponsor her, so no issues in that.

My payslips values:
June 2018 - £1300 (25 June - 30 June)
July 2018 - £6100
August 2018 - £5900
September 2018 - £6000
October 2018 - £5900 (projected)
November 2018 - £5900 (projected)

(Question) Will my June payslip cause problem as they may think my monthly pay is less than £1560?

Or will they understand that it was prorated pay? Payslip doesn’t say anything to that effect, but I can get my employer to do a letter in that respect.

I was director of my own company briefly (April - June 2018) and have closed the company. Have cleared my corporation tax, but don’t have CT600. (Question) Will this cause problem? Can get letter from accountant about it. I had income of £25000 via that company during that timeframe.

So my total earning this financial year has thankfully already exceeded the threshold of £18700.

(Question)What category should I apply under? Category A/B?

If I do go for category A, do I need 6 months payslip, if my income is above threshold in 4 months? In other words, can I submit just 4 payslips?

You are required to submit a minimum of 6 months payslips and 6 months bank statements. Anything less and you risk a refusal.

Thank you CR001, since I had my own company before permanent employement (I’ll have only 5 months payslip in date of her visa application) should I apply under category B?

Yes it will cause problems, as you will not be able to show a full 6 months of pay slips. It's not 6 pay slips, it's 6 FULL months of pay slips. Just wait until you get the sixth full month of pay! You cannot apply for Cat B as you were self-employed as your company director - which massively complicates things if you try to include it.

Have you read Appendix FM?

Thanks a lot, I had not read Appendix FM.
It is clear that I most certainly on 28 November do not qualify under category A and will led to application rejection.

I do not have significant savings for 6 months under one place, they are scattered across ISA, Banks, Bonds, Shares, so I can not rely on them.

Before being a director of my limited company (between 5April and 25June) I was salaried employee of umbrella company on base of £40,000 (1 September to 5 April)

So based on the salaried income from umbrella company plus, current employment, can I ask them to exclude limited company income and consider me for category B based on example (a) of section 5.3.11?

So income in prior 12 months excluding company director will be £48923 approx, thus in last 12 months will be higher than threshold of £18600
Thus in Appendix 2 of VAF4A, my spouse can answer section 3.21 and 3.22 as yes.

Yes you meet the requirement for CAT B. You will need to provide a lot more paper work, payslips, contracts, employee letters, bank statements from the past 12 months.

Or as already advised MANY times, just wait until you complete 6 months and go with the simpler CAT A.

It's up to you - but going by your persistence just go ahead with CAT B as you seem fixed with applying now.
