Dear All,

Thanks for help and also for any support from friends.

I think it is better to open a new topic to discuss this question.

I am under the category of 1+3 HSMP. My visa will expire in middle of June. I am not sure what I need to apply after JR.

1. HSMP extension under tire1? But risk is we may be treated by tire1 and HO can change rule again next year.
2. ILR apply directly? but risk is you may be refused by HO as new rule mentioned you need 5 years under HSMP

What can we do now for us? How many people like us will be affected?

By the way, under tier1 table, it mentioned about the entry time and place before you enter UK? what does this mean? Does it mean the first time you enter UK? for me, i entered in 2000 as a student. is it right?

Hope someone can help and point out how we can do now?

By the way, forgot to ask about Life in the UK test.

If we applied ILR
1. should we attend this test?
2. when should we attend? is there any time limitation such as how long before you take test?

I have not got time to attend this test.

1. It seems you will need to apply for another extension and in absence of any remedial process from BIA yet (subsequent to JR), as of now you will need to use the Tier 1 form. Refer to the JR in you cover letter and request that you be considered under the old rules (pre Nov'06). Maybe, by the time you get ready to apply (mid-June), BIA would have come up with some guidance - fingers crossed :wink:

Hi,

I was at PEO on thursday to submit my ILR application after completion of 5 years under HSMP. I had submitted last 3 months original payslips, last 3 months original bank statements, Life in UK test certificate and last 5 years Income tax returns/ SA statements received from HM revenue office. My Application has not been processed and they have asked me to submit last 12 months original payslips / P60 within 14 days

Is there any mandatory requirement to submit last 12 months payslips for ILR?

So which means at moment we can only apply extension now and only can be used form is Tier1 form? Is it? Thanks for clariying if someone can confirm it.

But if we submit the tier1 form, will we need to meet the criteria as a Tier1? I will include the JR judgement letter. However, any other documents should we submit when we apply extension. I guess it should be different from Tier1, is it? As if we apply by using Tier1 form, which means we accept the tier1 so we has to apply ILR after 5 years.

From HO's behaviour, I do strongly suspect that they try to postpone any feedback and actions till after Nov. 2008, which means everyone need 5 years to apply ILR. Then next year, they will change to another 6 years, which is their plan because the party will be changed soon.

Finger crossed that HO can face their fault and prove that we can apply ILR after 4 years as the initial package for us. Also, this has been mentioned in the JR as well.

Dear All,

thanks for help!

I need to send my application forms (tier1 only available at moment) before this week as it will expired on next monday.

however, i do not know how to fill the form under section 2 category D (Immigration History). What does it mean here? I entered into UK in 2000 and got HSMP in 2004. So which one i need to fill in? As i felt confused from D5 to D10 and help documents did not mention it.

The lawyer said it should be hsmp awarded date. But how i can fill d5 to d10? :oops: :cry:

Please give advice asap.

When you came to UK in 2000, you must have obtained entry clearance to enter UK (first time), right ?? Fill up D1-D4 accordingly.

D5. Are either the applicant’s current and/or any one of their previous passports or travel documents unavailable? If this is true, then you have to answer D6-D10, else leave them blank.

The questions D1 - D10 are related to your (first time) entry to UK ... and not necessarily when you entered UK under HSMP.
