ILR After 5 Years Tier 1 General PBS

Post by zeeshah2013 » Sat Oct 27, 2018 9:55 pm

Hi,

My wife has completed her 5 years as a PBS Tier 1 General applicant. She is originally from Pakistan.
Can someone please guide me regarding the process for her ILR . I already have British Citizenship (After taking ILR based on 5 year tier 1 route). We have a 2 years old daughter who is also British.

1) Which Application form and guidance notes i need to use/Download. (Links would be Helpful)

2) Does she need to apply for English Language Test (She did not when she first came as a dependant and for extensions).
If she needs to, then which one we she needs to prep and which qualification while inside UK.

3) Does she needs to apply for Life in UK Test as well for ILR or is it for British Citizenship only.

4) How much is the Fees for ILR application.

I have searched for the above and kind of confused so wanted to check and confirm with the experts.
Thanks in advance.

Zee

1. Set(O) same form you used. It is online or paper form.

2. She needs English B1 IELTS SELT.

3. Yes she needs LIUK test.

4. £2389 by post or £2999 in person (this service is changing soon though).

Hi CR001,

thanks for the prompt reply. Just on application form, is it not the Set (M) one ?
I'm confused between Set O and Set M as below is what the details are on the form regarding the applicant type.

Set M Form
https://assets.publishing.service.gov.u ... -07-18.pdf

Complete this form only if you are applying for indefinite leave to remain in one of the
following categories:
• Family life as a partner (2 year route - you were last granted limited leave of 27 or
24 months under Part 8 of the Immigration Rules and have completed at least 24
months with such leave)
• Family life as a partner (5 year route - you were last granted 30 months limited
leave as a partner under Appendix FM and have completed at least 60 months with
such leave)
• Family life as a parent (5 year route - you were last granted 30 months limited
leave as a parent under Appendix FM and have completed at least 60 months with
such leave)

SET-O
https://assets.publishing.service.gov.u ... -07-18.pdf
This form is for the following categories:
Tier 1 (Entrepreneur) migrant Representatives of an overseas business
Tier 1 (Entrepreneur) migrant, accelerated UK ancestry
Tier 1 (Exceptional Talent) migrant Retired persons of independent means
Tier 1 (Investor) migrant Bereaved partner
Tier 1 (Investor) migrant, accelerated Biometric immigration document (Biometric
Residence Permit (BRP)) Tier 2 migrant Other purposes/reasons not covered by other
PBS Dependant application forms
Employment not requiring a work permit

Can you please check above and confirm again for my satisfaction please

She doesn't hold a visa to qualify for ILR on Set M, ie spouse settlement visa FLR(M).

If she holds a PBS dependent visa and has held it for the required time she applies on SET O.

Your set O quoted text clearly states PBS DEPENDENT.

@ cr001 coming back to this old post. I believe the process is now changed and we need to apply online.
Just want to confirm list of documents that need submitting for my wife. also do we know where the help documents are stored now as old links have been removed.
Also can we apply for premium service now or not
