transfer of tier 2 visa close to expiry of old visa

Post by gily_g » Fri Nov 02, 2018 12:03 am

Hi!

I have a couple of questions I was hoping someone can assist with.

I am currently on a tier 2 visa which expires 1 Dec 2018. I have signed a contract with a new employer who is yet to begin processing my COS but has completed an RLMT.

The questions I have are:
1) If my new employer begins processing my application using the standard route and the application is still in progress after 1 Dec, can I continue to work with my old employer until the decision is made?
2) If I go through the premium route (10-day processing) to process my application with my new employer which does get approved before the 1 Dec, can I continue to serve my notice period with my old employer?
3) Can I process my application under the premium route and process the application for my dependents (spouse and kids) under the standard route?

Thank you in advance.

cheers

These are questions for the HR person at your current employer, but the answers are likely to be (1) Yes because you have section 3C leave, and (2) No, because of paragraph 226 of the Tier 2 Policy Guidance.

Yes if you wish.
I do not give immigration advice. I refer you to Immigration Rules, guidance, other online content and to your sponsor.
