Ineligibility for ILR and Citizenship with police cautions and offences

Post by jafersadeq » Wed Oct 10, 2018 12:20 pm

Dear members,

We know that if the applicant has a police caution or some offences he has to spent a specified time after that to be eligible for ILR or citizenship, if he does not spend that time some advisers advise him to extend his leave to gain more time to be eligible, I wonder if the applicant has a police caution or an offence he has a note in his record and it is enough evidence that HO can refuse his extension application because he has to mention it in the criminal section, so how those advisers advise him to extend his leave.
Is there an opportunity that migrant can extend his leave and he has a criminal record!

Thanks

As you have posted in the ILR sub forum, it might be useful to state WHAT visa category this 'person' holds and at least a hint to the nature of offense!!

I'm not sure why this topic was moved to Tier 1E subforum given that it has nothing to do with Tier 1E rules ?!

That was me, on my mobile, getting confused as the user asking again for a 'friend' asked about an extension

Simple caution leads to refusal of ILR. FPNs should not have any effect.
The case for citizenship is different. He got too many FPNs and this could have an effect

Dear zimba,

As you said, the police caution affects ILR, so can the applicant extend his leave with a police caution? , same requirements in both applications. Please clarify
Thanks

Yes extension should be ok as long as he is eligible and also declares the caution
