FLR M rejection and new application complications

Hello,

I have a bit of a complicated, multifaceted issue regarding my FLR M extension. I have had to submit and online from because of timing restraints but am trying to sort out the supporting documentation:

I am applying for an extension of FLR (M) (previously granted on 07/04/16 and before that I had entered the country on the youth mobility visa). I have lived with my partner, since moving to the UK on 07/04/14. At this point in time he is in Australia completing a pilot program. We hope to be able to keep living in the country in the meantime. We went to Australia on 11/02/18, I returned 2/10/18. He is a freelance sound engineer who in the previous tax year earned 25,429 GBP before tax.

I had a premium service centre appointment on 4/10/18 in Belfast and was rejected. The reasons given where that we had supplied the wrong financial information and that he was not present in the country. We had misunderstood which year was counted as the most recent tax year as the tax for 17/18 is not due until January. Therefore we had supplied 16/17. We have since completed his 17/18 tax return however have not had this done by an accountant. We did not use an accountant for our original FLR M application 2.5 years ago. Will this be a deal breaker? The woman at my premium service centre appointment had not raised it as an issue.

I had not realised that one point of the visa was that your partner had to be present in the country. The woman at the premium service centre gave me her number to contact her if I had trouble rebooking an a appointment. However as my partner wouldn’t be able to be present at an appointment I have submitted a postal application form online (as I had to but have not yet submitted my supporting documentation)

I am now concerned I may have made a few errors in my form that the home office will reject my application again or get me in serious trouble. We had been living in a flat from 19/8/16, however when we went to Australia we passed our lease onto our friends. We still have stuff here and this is where I am currently living, however the lease and council tax are in their names. I have correspondence documents for this address leading up to the present. I didn’t really think about this when filling out the form and declared this as our address and that we were the only ones living here, as for most of the past two years we were. It was something that we were going to sort out after getting an answer from the home office.

In my online application form when asked if my partner is present in the country I said no but that he would be returning 10/10/18, as at the time we had hoped he could do that however was unable to make the flight. After speaking with a lawyer she said it should be ok if we prove that his study is the reason for him being out of the country.

I am worried that the home office will interpret this as being deceitful and ban me from entering the country. If this is a risk I don’t want to go forward as that would destroy our future plans of making a life here.

A few things are not clear from your long post.

Is your partner a British citizen or does he hold ILR?

Are you in the UK or abroad? Flr M can't be applied from abroad.

What is your current visa status in the UK?
Char (CR001 not Casa)
