Hey All,
At last finally found where i should have placed my post, sorry already posted in two other locations. Still trying to navigate on this site.

Need serious advice here please if you can. Been in the UK since 2002 as a student, had visa till 2006(renewed every year after paying school fees). Well after that i had no job and couldn't keep up so i ended up overstaying from ending of 2006 till i put in an application for Residency card as i had married my wife, an EU by 2008. Let me explain what occurred in between, meet my now wife Nov 2006 and dated for some months, by then my visa had expired. Then i was already contemplating what to do with my life as i had no one to go to back in my country. My parents were British citizens by naturalization years ago and my younger siblings were all born here so citizens by birth. I had been to Britain years ago when young and unknown to my parents had been sent back home to school and have some form of moral discipline(has i was heading towards being naughty at my young age). Well that ended up being the worst decision my parents did and i ended up losing my rights to stay under the Margarete thatcher era(2 years). So long story short, it took me many years to be allowed back to study after so many bad excuses from the immigration officers at the consulate. I had no family there besides extended ones, those periods were not memorable and my parents had to try to come and visit once a while. I ended up not seeing my younger ones born and grow. Finally came and then no visa, went to various lawyers and they said unfortunately nothing i could do. So during my period of thinking what next i met my girl and stayed with her during that period i had no visa. Well, going to the next year into 2007 and April period she told me she was pregnant, well that was not expected but then i knew i wasn't going to go without seeing my only child. so we managed till we were able to marry at my family church( church my mum goes to and me when i visit London. And then applied from there for my residency(2010 - 2015) till now when i was able to get my PR(2016). Well with this overstay situation going on and me not having a visa from 2007, got married late Nov 2008 and then applied there after and got a letter to work 2009 and then 2010 got my residency card till 2015 and 2016 PR. What do i do please with regards to applying for naturalization, something that i should have had more than 30 years ago. And i still have the letter they sent me 1979 stating that i was free from immigration restriction. Please any advice will be appreciated. Sorry for the long essay.

It is unclear form your post, which is very difficult to read as one long paragraph, whether you have applied for citizenship or not.

If you had ILR sometime before 2000 you will have lost it after any 2 years absence from UK.

If you now have PR you could shoot for privilege of citizenship 10 years after legalising your status in UK; (looks like 2018 from what I understood of your post).

This assumes all other requirements have been/can be met by then.

Thanks for the quick replies CR001 and Noajthan, its good to know that others are willing to share their knowledge. I have not yet applied for British citizenship yet due to my overstay situation as i mentioned. I applied for my Residency card early 2009 and got a COA that allowed me to work that year(2009), there after was given the Residency for 5 years starting 2010 - 2015. Now i know due to my overstay during the 2007-2008 period, even though i was living with my wife to be and expecting a child then, i may get refused. I just want to know do i start counting my 10years from 2009 when HO got my application and sent me a COA or from when the actual date on the Residency card 2010? Thanks.

Hello Everyone,

Would like your expertise on this one please.

Entered UK 2002 as a student, 2006 visa expired September and by then had no more money to continue my studies.
during that period i can say i overstayed starting from september till 2008 November.

To be honest my life then was how to educate myself and be someone and not to be thinking on visa matters but as i found out the hard way, it does matter. I was depress during that dark period.

During 2006 - 2008, i met my now wife by November of 2006 and started dating, still wasn't working but relying on both my parents who happen to be British (residing here too) and my extended family.

girlfriend and i moved in together couple of months later and during that period she found out she was pregnant. 2007

Got married 2008 November and ended up applying for Non- EEA spouse Residency Card on the 18th November 2008.

HO sent a Certificate of Application back to my lawyer on the 16th of December, which was officially received on the 22 December - Do i take it that during that 18th of November when i sent the application and the 16th of December when HO sent my COA letter, that its a sign of them being aware of my Status of an Over-stayer. as i have had to give my passport to them and am sure they knew my last visa was valid till 2006 September.

Anyway received my Residency card on my passport September 2010(took them close to 2 years to answer me)

February 2016 received my Permanent residence card(biometric format).

During all these period, i have had no police problems, no debts, went back to school and now a Analyst for a financial services company and still married to my then girlfriend with a beautiful 9 plus daughter.

When please would be the safe's time to apply for BC for myself and my daughter? Wife is EEA citizen and will apply for permanency soon enough.

And due to my 10 years being after my overstay, should i still have to mention that or not?

Now from my calculations, this December ending should make 10 years due to Good character requirements right?

Yes. You became a family member from the date of your marriage. So, ten years counting from that date should be okay.

Application/Raised Date - meaning please

Hello everyone,
Just a quick help from the SME on here.

Summary of my timeline in question:
- 09/11/2008 Married EEA Spouse
- 18/11/2008 Application/Raised Date for EEA - Residence Card application received by HO (as stated in the SAR report i requested for)
- Those that mean between 18/11/2008 to 19/11/2018 could make 10 years to qualify to apply for BC?

The concern i have is that my RC card date starts from 2010 - 2015, but i put in my application 2 years earlier and the HO received or became aware of my status when the application was received by them from the 18/11/2008.

Any advise would be nice, Thanks all.
