About to apply for Tier 4 visa but just received curtailment letter

Post by kumar114 » Fri Nov 09, 2018 10:10 am

Hi,
I just received curtailment letter today.
Now it expires on 7 January 2019.

I have already received an offer from university and I am planning to apply for my tier 4 visa with dependant on 6 of December.

Because I have received that letter, will it be a problem when I apply for my Tier 4 visa? Is there a high chance of rejection now?

Kind Regards
Kumar

Having a previous visa curtailed in itself has no bearing on a new application. However, if a visa is curtailed for reasons of deception, or for breaching visa conditions, or for reasons that might call into question someone's credibility as a student in future, this could affect a future application.

You do not say whether you are making the new application in the UK or in your home country. In order to apply in the UK, you must have successfully completed the course for which the current visa was issued, and the new course must start no later than 28 days after the curtailment date.

If this information has raised any further questions, I strongly advise you contact the international student adviser at your university for advice on your application.
I do not give immigration advice. I refer you to Immigration Rules, guidance, other online content and to your sponsor.

Thank you for a quick reply.
I am applying in UK.
Current visa is Tier 2 General. The reason was because the company went bankrupt and the licence got expired.

My course start date is 14/Jan/2019.

Do you think I am in a safe side?

Current visa is Tier 2 General.
I assumed it was also Tier 4, hence my reference to the previous course. That requirement is irrelevant to someone switching from Tier 2.

Thanks again.
On my curtailment letter, I am asked to send them my current BRP.
So i don't get that.
1. Don't I need BRP to apply for my Tier4 visa?
2. I have a wife as a dependant. The letter does not mention anything about dependant? Will she also get a separate curtailment letter?

Check this with the international student adviser. It's possible to apply without it, but they can advise on your options.

It doesn't matter. Their leave is tied to yours, so if your leave is curtailed, theirs is automatically not usable anyway.
