Wife was paid twice in 1 month, will this affect my spouse visa application?

Post by Adriani101 » Sat Nov 10, 2018 9:33 am

Hi everyone,

I am a national of Kosovo and live there too, my wife is also originally from Kosovo but is a British citizen and lives in the U.K.

We are in the process to start my spouse visa to apply under CAT A but are waiting for the month of November to be over as that is when my wife will receive her 6th month payslip. On the 29th of October 2018, my wife noticed that she still had not been paid for the month of September and e-mailed her employer's to tell them :? So that day her employers paid my wife her monthly net salary of £1450 but also an additional £1450.

My wife had to go on a business trip the day after and spoke to her employers after she got back to tell them that she was paid an additional £1450. She was told that as well as being paid for the month of September she was also paid for the month of October. (But the month of October was still not over as there were 3 days left) and normally you are supposed to be paid the next month for the previous month right? Obviously this wouldn't be a problem if we weren't applying for the visa but it actually is?

Can anyone advise on what her options are here please? I was thinking this..

1. Transfer money back to employer today and tell them to transfer it back to my wife so it shows it did include the full month of October. Then include an explanation letter from both my wife and her employer with the visa application stating it was a mistake?..

2. I actually don't know!?

Thank you guys!

Shouldnt be a issue if the employer can explain the error in a letter

You could also cheekily ask the employer to state something like "I also confirm that Mr xxxxx has earned £10,300 in salary for the past 6 months. There was an error in payment for November 2018 where two payments were made. We have rectified this error. Kindly bare in mind that, regardless of the error, Mr xxxxx would have still earned £10,300 in total for the past 6 months of salary, including his usual monthly salary of £1,600"

Apart of employer letter clarifying such error, ideally the revised payslip of such month must be attached.

Hi Londoner 007,

Thank you for the template of the letter I think my wife employers will be fine with writing the letter for her. I am sure the Home Office has a checklist for each application and I don't want to risk it by not writing a letter stating the error so thank you!

Hi Seagul,

Thank you, will definitely tell my wife she will need to attach payslip.

I have another question if anyone is willing to help! My wife 6th months payslip does not fall into the category of the tax year (April) but should she still attach her P60 to my application?

Thank you

P60 is not a requirement document. If it shows gross earnings of £18,600 for past year then attach it. Otherwise I wouldn't. If it shows less than £18,600 it may confuse the ECO. It is more important to show last 6 months payslip, 6 months bank statement and employers letter, include contract if you have it.

P60 & job contract is not mandatory and ideally shouldn't be attached if 6 months of payslips & bank statements and employer letter is included.
