Tier 2 PBS dependant applying for ILR

Post by mrstyler » Tue Nov 13, 2018 4:50 pm

hello there

i am planning on applying for ILR after being here in the UK for just over 5 years on a Tier 2 PBS dependent visa, my husband had his ILR back in September 2016 through Tier 2 (general) and he is planning on applying for British citizenship soon.
i just want to make sure that i am using the right form and that i understand what are the requirement so my questions are as follow:
- is the correct form SET (O) for me the dependent to apply for ILR?
assuming that the correct form is SET(O), do I or my husband need to meet any financial requirements for me to be granted ILR?
as i understand i am the main applicant do i need to provide any documents for/from my husband to support my application?
thank you in advance for your help, if anyone been through this and have any advice please do share.

king regards

Rajaa

Dear CR001

i am back for more advice, i went to an immigration adviser so she can look at my file and see if everything is in order, however she told me that for my application SET(O) i need to show my maintenance funds, i am almost sure that for a PBS dependent i do not need to do that, i have been reading through the immigration rules, and in Paragrapah 319E there's no mention of that an looked through grounds for refusal also nothing, is there a specific paragraph in the immigration rules that give that certainty? because if don't a maintenance fund i can apply now but if i do i will have to wait and get our finance in order for 90 days which will delay my application considerably, and i also want to send an email to the adviser and show her that.

thank you again for your help.

regards

There is NO maintenance fund requirement for ILR at all.
