Spouse visa or ILR

Post by Penny12 » Tue Nov 13, 2018 9:43 pm

Recently I got ILR on 10 years (long recedency) basis. My wife came here in the UK in March’2014. At the moment, Her FLR FP application’s decision is pending.
Which category of visa does she need to apply?
Can She apply ILR after once she complete 5 years in March 2019? Thank You

If she her FLR (FP) is issued it will be most likely for 10 year route. So in that case she will get ILR after 10 years. What is your wife's current immigration status?

She was tier 2 dependent before applying FLR (FP). Currently her FLR (FP) is pending. She didn’t received any decision yet.

She won't qualify for ILR in 2019. Her clock is reset to zero because you got ILR based on long residence and not pbs route.

But if her FLR FP is approved, then earliest when can she apply for ILR? After 10 years from the approval of this visa

OR

Can she apply on 10 years basis in 2024 as she came in Uk first in 2014?

Thank you

Surely if you were on a Tier 2 you met the financial requirements. Why didn't you apply for FLR (M)? That would put her on a 5 year path (if visa is granted). Which would probably make her eligible about the same time as on the long residence route...

That time she has not got the English exam. We asked passport from HO so she can do the English test and after that we switch her application to FLR M. that’s why we continued her FLR FP.

But can you tell me please even after FLR FP Visa,
Can she apply ILR in 2024?
Thanks

I didn’t do ILR on tier 2 basis. It is on 10 years route.

You've completely missed my point:
"Surely if you were on a Tier 2 you met the financial requirements."

This means you MUST have earned over £18,600 per year and therefor you could have applied for FLR(M) instead of FLR (FP) as this is considered a more straightforward application. Why didn't you apply for FLR (M) then, as that would be the more usual course?

She hasn’t got English exam and for that she needs passport, her passport is with HO, bcus of pending previous file. We requested passport couple of time from HO, but we didn’t get it yet.

That’s the reason we continued FLR FP.

So can you please, tell me if her visa is granted on the basis of FLR FP. Can she eligible for 10 years route in 2024? On the continuity basis

Or she needs to continue her FLR FP Visa for 10 years and apply ILR in 2029?

Thank you in advance
