Can I apply for ILR

Can I apply for ILR

I came to UK in 2006 as student. I married may partner (british national) in 2011. We submitted our application but it was refused. We appealed and even that was refused. My partner asked to review the case after that. That also came back as a negaive result.

To cut the long story short. To date we could not establish why HO denied our applications. Every time their reason was only that they are not convinced that we had a genuine relation. In 2013 we were cash strapped after spending about 6k for lawyers and court fees etc. and I was told by my solicitor to not fight the case anymore for the moment. I did what I was told. After a few weeks we received a letter from HO to go to some place and do the signing in and explain my situation to them. By that time we had our little baby with us so we went as a family there. They were a little puzzled after listening to our story as to why we have been through this all. They suggested to apply as a family.

Again to cut this short, I was given a 2.5 yrs leave under 10 year route (although my partner's income was over 18k) We tried to enquire as to why it was a 10 yr route but the reply we receieved was that it is the only route I was entitled to. After 2.5 yrs I applied for an extension, which took 8 months for them to approve. It was frustrating.

I want to know whether I can apply for ILR at all?

My next extension is in 2020. I would prefer not to go through the same hassle if possible.

You can only apply for ILR after you have completed your current 10 year route to settlement. So am guessing around 2022 or 2025

How can it be around 2022 please? Also I have heard something like 6 years marriage or partnership route as well (asking in case I might be able to go through that route if possible). I am not sure what the comprises. I was granted my visa in 2014 fyi. thanks

If you switch to the 5 year route on FLR M, it is a NEW 5 year PERIOD you have to wait. Not including the time you have already spent in the UK on the visa you hold.
