UK Partnership Visa Questions

Post by adamnsight » Fri Nov 23, 2018 10:20 am

Hey guys,

Very new here so apologies if this isn't the correct posting location.
I am a UK national and my girlfriend USA; we lived together in Dublin for a year before moving to the UK for her to study her masters. This would mean we have been living together for two years.

I was just wondering, as the partnership visa states that it requires couples to have been living together for two years, is this only applicable in the UK? Would they count our time together in Dublin?

Also, what sort of evidence do they need? We could possibly provide a tenancy agreement but she wasn't on the lease. We would only have her 12 month work visa for Dublin. Though we can prove we've lived together in the UK.

Best,
Adamnsight

No and yes.

Evidence of joint financial commitments and accommodation of living in a relationship akin to marriage for a minimum of 2 years. Page 63/54 of the archived paper form explains what HO expects to see.

What visa is she currently on, a student visa??

Thanks for such a prompt response! That's really useful to know and thanks for the link!

She is on a student visa, which is due to expire in January. We were hoping to apply for the partnership visa in December, which would hopefully grant her 2.5 years in the UK.

Neither of us makes a whole lot of money, but our combined income does meet the £18,600 requirement. We were hoping, as she invested education here, they'd still consider us.

Hope she doesn't work more than 20 hours per week.

Such an ominous response.

She does.

However, when the school season is out, you are legally allowed to work more than 20 hours per week. Thanks for that useless comment though.

You may have dismissed the comment as 'useless', but CR001 was flagging up the potential loss your visa fee if your partner was working more than 20 hours during periods of study.

Except that wasn't made remotely clear?

I've been appreciative of the help but that comment was useless.

In my opinion the point highlighted regarding 20 hours working by Casa & CR001 was very important which your brain might not pick up very well.

@seagul, I believe the OP was 'splitting hairs' between the value of 'has she been working' and 'I hope she hasn't been working'.

I hope so but not all students even get 20 hours of entitlement rather 10 hours. And also not all study programs for international students grant plenty of off days in which of course they can work fulltime.
