ILR 10 year route or spouse route

Hi Everyone,

I am about to apply for my ILR 10 year visa.

I came here in 2008 on student> psw> Tier1 (Entrepreneur) and am currently on Spouse Visa for the past 3 years.
I was assuming ILR 10 year will be straight forward as there are'nt many documents to submit, however,
after reading cases on this board, it seems, its not as easy as I initially assumed.

Can some one please confirm this for me please:

1. If i apply for ILR (10 year) and get rejected, will my current visa also be curtailed? as it is valid till 2020.
2. Do i have better chances of getting settlement through spouse 5 year route or should i apply for ILR
10 year route? and even if it gets rejected, i can always later apply through the spouse route?
3. I have never broken any law or anything, however during the past 10 years, the only issue i can see
is for the Tier 1 Entrepreneur visa, I did not fully invest the 50K, which was a requirement for extension,
and as i switched to spouse visa, i think its not an issue? Can the HO refuse based on this? i am not sure
if this is an issue as such? can some one please confirm this point?

1. No it won't.

2. Your choice if you qualify for either.

3. ILR LR is not a rehash of tier 1 ent requirements and you switched visa category.
