T1(E) to ILR - only main applicant applying with dependants

Dear CR001,

I am applying in Feb. 19 for ILR without my family who got leave to remain until Sep. 19 as tier 1 (Entrepreneur) dependants. Not applying for wife and children because they will be travelling abroad for holidays in April and July.

I just saw your comment/advice to a forum member “All people have to respond is that MN1 under Section 1(3) will be applied once ILR is granted”. This point is helpful for me, please elaborate this point, I know nothing about it. Your explanation would help me in writing explanatory covering letter.

I am thinking about writing a covering letter with the application, explaining why are not my dependants applying with me. So that caseworker wouldn’t think of writing to me to know this?

When do your dependents qualify for ILR??

Are your children UK born or were they born abroad?

My wife will be qualified for ILR at the same time when I’ll be in Feb. 19

My wife and a child who born outside the UK, both arrived in the UK as my dependants in April 2012.
Two children born in the UK, 5 and 1 year old.

We all have leave to remain until Sep. 19.

Can I make separate ILR application in Feb 19 on the completion of 5 years continuous residence, and by the grace of god if it’s approved before Sep. 19. My children can register for citizenship and my wife can apply for ILR on tier 1 (E) 5 year completion as dependent.

Your wife and child born abroad can apply for ILR at any time before their visas expire.

The UK born children can be registered as British on form MN1 once you get ILR.
