Earliest time to apply for ILR

Post by aster90 » Sun Dec 02, 2018 8:28 pm

Hi guys,
I know this question is being asked before but I'm still very confusing. I'm asking for your advice on my case.
I entered in the country on 16/04/2014 on fiance visa which gave me 6 months duration to get married.
After I got married with British citizen, I applied for FLR on 5 years route.
My 1st BPR card was issued on 10/09/2014 valid until 10/03/2017
My 2nd BPR card is issued on 21/03/2017 valid until 19/10/2019.

To be able to apply for British citizenship, I must have ILR and now I'm going to apply for one but I'm not sure when is the earliest time I can apply for this ? Some people said I can apply 28 days prior my 5 years completion which means the from 20th March 2019? I wonder if this is correct information ? or I must wait and apply 28 days prior expiry date on my current BPR ?

Thank you very much. I really appreciate for all your help and advice .

You can apply no earlier than 28 days before completing your 5 year period on your Spouse visa. The time spent on a fiance visa doesn't qualify.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

What advice are you looking for??

Casa has given you the correct advice. You need 5 years on the spouse visa, fiance visa does not count for ILR.
Char (CR001 not Casa)
