Spouse applying for Citizenship

Post by phsmall » Sun Jun 01, 2008 9:27 pm

Hi

I've been married for 2 and a bit years and a couple months ago got my Indeifinite Leave to Remain.

Unfortunately my other half has left me and decided to move out. We are hopefully going to start going to counseling as I really don't want things to end. I'm still in love and want it to work.

My question is can I apply for my citizenship after having ILR for a year, even if we are separated but still married?
Or do I then have to wait for 3 years?

Thanks very much.

You can apply for citizenship under the 3 year rule (spouses of British citizens) provided you are legally married on the date of application.

Was your spouse born in the U.K.? If so, recommended to get hold of a copy of spouses birth certificate.

Otherwise you'll need to apply under the 5 year rule.

Great thanks for that.
Hopefully everything will work out anyways...
