Tier 4 switching to FLR (M) travel question

Post by riyeshannon92 » Tue Dec 11, 2018 12:45 pm

Hello

I am an American citizen currently in the UK on a Tier 4 visa which will expire Jan 18, 2019. I am in the process of switching my visa to a Married partner visa (FLR (M)) soon. My fiancee and I got the earliest date for our wedding on Jan 11th, 2019. I know I am okay to apply Jan 12th for the FLR (M) visa but I already had flights booked to go home to the US for xmas and I was wondering if I will have a hard time coming back into the country around Jan 5th or so when my current visa is set to expire Jan 18th.

I talked to an Immigration lawyer and they said I should be okay as long as I explain I am getting married and I am applying to switch my visa.

Can anyone confirm this? Will I have a hard time coming back into the country on my tier 4? Can they deny me entry?

thanks so much for your help!

Did they cite any specific Rules or guidance to support this?

Yes. See the discussion in the Pinned Topic "Travelling after final exams" about how re-entry can be a problem and why:

I would be advising you to postpone your trip, or to make the spouse visa application in your home country while you are there.
I do not give immigration advice. I refer you to Immigration Rules, guidance, other online content and to your sponsor.
