resign or wait for approval?

Hi

I hope this is not too much of a stupid question but I really really hate my job and want to resign as soon as I can. I called a reputable visa company and the consultant says if they agree to take on my case then it would be a safe bet for me to resign first. (I'll be meeting them next week) However, another visa company told me to wait until I get my tier 1 before I resign.

I'm not sure what I should do? Ordinarily I guess the logical thing to do is wait but I really really hate my current job and its making me depressed.

I'm on a workpermit, wanting to change to the tier 1. I have enough points and all my documents are obviously genuine, so if a lawyer does take on my case, do you think it would be ok to quit first?

You are asking for peoples opinion "at what they would do" and I am sure at the end of this, you would be more confused than you are now

In my opinion - There is enough excitement and problem in your life while you are waiting for Tier1, that you would want to avoid all the other tension after you quit, your employer cancelling your work permit and the worry of finding a new job quickly in case your Tier1 is delayed by the HO.

So I would wait until I get a Tier1. Again this is my personal opinion. You are the best to judge, because I don't know how much you hate your job.

thansk for that. I also wanted to ask, if the lawyer tells me that they can get me a visa, and all my documents and information are genuine, should I fully rely/believe that he will get my visa approved? They have alot of experience so i don't see why i shouldn't trust them and resign first? Or am I just being niave?

Well, I tend to agree with Hussain. It is always better to be planned then sorry.

You will creat more worries if you resign, your WP will be cancelled and you will be no where.

Just thought; Why you dont consult your lawyer, sicne you have one and are in contact with.

It ain't over until the fat lady sings - in this case until the visa is stamped in your passport and its in your hands.

And no one can "get" you a visa.... anyone who claims so is just taking you for a ride.

Waiting for Tier 1 approval is very stressful and there are lots of stories of minor issues causing delays or rejection. Maybe when you are having an especially crap day at work, instead of resigning, you can think about how good it will feel to resign with a Tier 1 safely in hand?

The very fact that you felt the need to go through a lawyer / visa agency, rather than file on your own clearly indicates that you are not sure of your chances of success. Dont resign. Also what makes you think you will not hate your next job? Dont take your job personally, u r in there just to pay your bills and till you find another one.

And then there could be other situations beyond your, HO & your lawyer's control. Many people lost their original dox when the Sheffield office got flooded last year. It was a painful wait for many despite the fact that they had all that it required to get the VISA. If you have carried it on for so long wait for a few more weeks in the same job.

My advice to you is that you should wait. dont resign unles you have enough funds to support urself for good 10-12 months,

I went to see the lawyer this morning and he said that I qualify for the visa and he would take on my case but I need to get a copy of my degree because I only have the academic record. All the other documents are good.

He said that same thing as everyone is saying, wait for the visa and then resign :( However, he could give me a more definitive answer once he is about to process the forms. The problem is I can apply for the tier 1 visa on July 1 but because I am going overseas in August, I have to wait until I come back in September as it can take up to 3 months to get my passport back. Anyways, I feel better knowing that he said I had a very high chance of getting the visa.

He did say that if I could get another job offer (job offer letter) and then he would be able to speed up the process a little more.

what happened to the people whose documents got ruin by the flood? How did they get compensated???? That's really bad

republique are u sure about this information. to best of my knowledge, this is not true.

SO i would sugest to check with some professional or HO (althogh HO call centre is rubbish).

This was beyond the control of even HO. One of my friend was advised to arrange for all the originals again (duplicate copy) while HO was happy to process her application based on the photocopy they had in their records - This was an HSMP approval application so her passport was still with her. Most of the applicants, however, suffered inordinate delays in processing of their applications rather than complete loss of documents.

With Tier - I being a single stage process in which approval as well as VISA stamping taking place almost simultaneously, I am not sure how would it help ppl in situation like JESSIES? I mean you apply for Tier-I approval without a passport and then get it stamped later on? There does not seem to be a specified procedure for such an arrangement, as far as I know.

Where an applicant is unable to submit their current original
passport/travel document at the time of the application, full

The only exceptional circumstances in which alternative
specified documents may be provided are where the
applicant’s current passport/travel document has been:
• Lost;
• Stolen;
• Expired and returned to issuing Government;
• Submitted to another department of the Agency.

In the exceptional circumstances outlined above, the

1. Valid national identity document
or
2. Valid UK driving licence

junior considering this, its of hardly of any use for anyone, unless they have above mentioned situation. so you just cant decide not to send ur passport coz u dont want it to be stuck with HO.

I agree with everyone else. Just try to ride it out until you have the visa in hand. You don't need to put yourself through any more stress on top of applying for visa. Believe me, my last job was a complete nightmare, I had to just train myself to let everything not get to me while I was at work. It can be done. ---I will say, that if you feel you are being abused or it is emotionally damaging to stay there and that it is not possible to go on, then just quit. Nothing is worth that!
