ILR for PBS Dependant Leave to Remain

Hi ,

I have got my ILR through Tier 2 General (5 year) route in June 2018. I need to apply for my husband's ILR, we had to extend his visa in July, 2018 as he was still short of few months to apply for his ILR before his visa expired. He now have visa until 2021 but also eligible to apply for his ILR and on his BRP it says - PBS Dependant Leave to Remain.

If we follow the settlement checking service then we end up with Set(M) form , but reading the posts here , confused as to which form we need to apply , Set(O) or Set(M).

Any help will be highly appreciated.

It is Set O.

He cannot apply on Set M as he doesn't hold a qualifying visa to use the form.

If I may ask what is the criterion for Set(M) form.

Also why do the UKBA settlement checking form points to that.

Holding a spouse settlement visa (2 x 2.5 year visas) for 5 years.

It is based on the answers you put. If you put ILR and dependent of ILR person, it would give you set m but that is not what visa is held.
