Hi I am wondering someone can help me
We had a child born in october 2018 while my mrs was on fiancee visa in UK hospital
he is now registered with my name on his birth certificate as father.
I am british pakistani and my wife (whos on fiancee visa ) is pakistani.
Can i apply for british passport for my child ? or do i have to marry first ?

Your child is British due to you being a British citizen. You can apply for child's passport.

Children born on or after 1 July 2006
For a child born on or after 1 July 2006. The following can meet the definition of
father for British nationality purposes:
• the mother’s husband, if any, at the time of the child’s birth
• any person who is treated as the father under section 28 of the Human
Fertilisation and Embryology Act 1990 or section 35 or 36 of the Human
Fertilisation and Embryology Act 2008
• a person who is treated as a parent of the child under section42 or section 43
of the Human Fertilisation and Embryology Act 2008 (second female parent)
• if none of the above apply, a man who can be proved to be the father by the
production of either:
o a birth certificate identifying him as such, issued within 12 months of the birth
of the child (where the birth was registered before 10 September 2015)
o other evidence, such as a DNA test report, court order or birth certificate that
demonstrates paternity

you reckon child birth certificate is enough or shall i also attach DNA test to make it more relevant ?

You produce either
- the birth certificate (with your name on it)
OR
- DNA test etc.

as the wording says.

On a separate issue, you need to ensure that any outstanding NHS charges your fiancee may have relating to the birth, are paid before submitting the FLR(M) application. :idea:

Different rules applies to different parts of the UK. In Scotland for example, if the father has been ordinarily resident there for a period, then there is no requirement for the spouse to pay for NHScharges.

really i paid 4500£ for a delivery :( ah i wished i knew it before as my parmanent address is from scotland and i could have taken her there :(.
I had paid the dues , do i need to submit a proof or anything ?

on a slighty different note is any of of you know to give notcie for marriage do we need to go together or we can go alone turn by turn ?

If it is NHS, you could reclaim you fee on the basis that she was not required to pay according to Scottish law.

There may be a case under Regulation 4B, for fee to be refunded, as they are not allowed to charge.

I assumed England, as it appears from the comment above that the birth wasn't in Scotland :idea:
